INSTITUTE CARGO CLAUSES (AIR)
INSTITUTE CARGO CLAUSES (AIR)
(EXCLUDING SENDINGS BY POST)
RISKS COVERED
1. This insurance covers all risks of loss of or damage to the subject‐matter insured except as provided in Clauses 2,3 and 4 below.
EXCLUSIONS
2. In no case shall this insurance cover
2.1 loss damage or expense attributable to wilful misconduct of the Assured
2.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject‐matter insured
2.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject‐matter insured (for the purpose of this Clause 2.3 “packing” shall be deemed to include stowage in acontainer or liftvan but only when such stowage is carried out prior to attachment of this insurance or bythe Assured or their servants)
2.4 loss damage or expense caused by inherent vice or nature of the subject‐matter insured
2.5 loss damage or expense arising from unfitness of aircraft conveyance container or liftvan for the safe carriage of the subject‐matter insured, where the Assured or their servants are privy to such unfitness atthe time the subject‐matter insured is loaded therein
2.6 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against
2.7 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the aircraft
2.8 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
3. In no case shall this insurance cover loss damage or expense caused by
3.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by oragainst a belligerent power
3.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat
3.3 derelict mines torpedoes bombs or other derelict weapons of war.
4 .In no case shall this insurance cover loss damage or expense
4.1 caused by strikers, locked‐out workmen, or persons taking part in labour disturbances, riots or civil commotions
4.2 resulting from strikes, lock‐outs, labour disturbances, riots or civil commotions
4.3 caused by any terrorist or any person acting from a political motive.
DURATION
5.5.1 This insurance attaches from the time the subject‐matter insured leaves the warehouse, premises or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either
5.1.1 on delivery to the Consignees’ or other final warehouse, premises or place of storage at the destination named herein,
5.1.2 on delivery to any other warehouse, premises or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either
5.1.2.1 for storage other than in the ordinary course of transit or
5.1.2.2 for allocation or distribution or
5.1.3 on the expiry of 30 days after unloading the subject‐matter insured from the aircraft at the final place of discharge, whichever shall first occur.
5.2 If, after unloading from the aircraft at the final place of discharge, but prior to termination of this insurance, the subject‐matter insured is forwarded to a destination other than that to which it is insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.
5.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 6 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to the air carriers under the contract of carriage.
6.If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a place other than the destination named therein or the transit is otherwise terminated before delivery of the subject‐matter insured as provided for in Clause 5 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either
6.1 until the subject‐matter is sold and delivered at such place or, unless otherwise specially agreed, until the expiry of 30 days after arrival of the subject‐matter hereby insured at such place, whichever shall first occur, or
6.2 if the subject‐matter is forwarded within the said period of 30 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 5 above.
7.Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premiumand on conditions to be arranged subject to prompt notice being given to the Underwriters.
CLAIMS
8.8.1 In order to recover under this insurance the Assured must have an insurable interest in the subject‐matter insured at the time of the loss
8.2 Subject to 8.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.
9.Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a place other than that to which the subject‐matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject‐ matter to the destination to which it is insured hereunder. This Clause 9, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 2, 3 and 4 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.
10.No claim for constructive Total Loss shall be recoverable hereunder unless the subject‐matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject‐matter to the destination to which it is insured would exceed its value on arrival.
11.11.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured. In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
11.2 Where this insurance is on Increased Value the following clause shall apply:
The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
BENEFIT OF INSURANCE
12.This insurance shall not inure to the benefit of the carrier or other bailee.
MINIMISING LOSSES
13.It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder
13.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss,and
13.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised and the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.
14.Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject‐matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.
AVOIDANCE OF DELAY
15.It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.
LAW AND PRACTICE
16.This insurance is subject to English law and practice.

RISKS COVERED
1. This insurance covers all risks of loss of or damage to the subject‐matter insured except as provided in Clauses 4, 5, 6 and 7 below.
2. This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 or elsewhere in this insurance.
3. This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment "Both to Blame Collision" Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim.
EXCLUSIONS
4. In no case shall this insurance cover
4.1 loss damage or expense attributable to wilful misconduct of the Assured

4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel
4.7 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
5.5.1 In no case shall this insurance cover loss damage or expense arising from unseaworthiness of vessel or craft,unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject‐matter insured,where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject‐matter insured is loaded therein.
5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subjectmatter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness.
6.In no case shall this insurance cover loss damage or expense caused by
6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power
6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat
6.3 derelict mines torpedoes bombs or other derelict weapons of war.

8.2 If, after discharge overside from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.
8.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transshipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.
9.If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters,either
9.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur,or
9.2 if the goods are forwarded within the said period of 60 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.
10.Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.

1.This insurance covers, except as provided in Clauses 4, 5, 6 and 7 below,
1.1 loss of or damage to the subject‐matter insured reasonably attributable to
1.1.1 fire or explosion
1.1.2 vessel or craft being stranded grounded sunk or capsized
1.1.3 overturning or derailment of land conveyance
1.1.4 collision or contact of vessel craft or conveyance with any external object other than water
1.1.5 discharge of cargo at a port of distress,
1.2 loss of or damage to the subject‐matter insured caused by
1.2.1 general average sacrifice
1.2.2 jettison or washing overboard
1.2.3 entry of sea lake or river water into vessel craft hold conveyance container liftvan or place of storage,
1.3 total loss of any package lost overboard or dropped whilst loading on to, or unloading from, vessel or craft.
2. This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 or elsewhere in this insurance.

4.7 deliberate damage to or deliberate destruction of the subject‐matter insured or any part thereof by the wrongful act of any person or persons
4.8 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
5.1 In no case shall this insurance cover loss damage or expense arising from unseaworthiness of vessel or craft,unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject‐matter insured,where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject‐matter insured is loaded therein.

4 .In no case shall this insurance cover
4.1 loss damage or expense attributable to wilful misconduct of the Assured
4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject‐matter insured
4.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject‐matter insured (for the purpose of this Clause 4.3 “packing” shall be deemed to include stowage in a container or liftvan but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)
4.4 loss damage or expense caused by inherent vice or nature of the subject‐matter insured
4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)
4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel
4.7 deliberate damage to or deliberate destruction of the subject‐matter insured or any part thereof by the wrongful act of any person or persons
4.8 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
5.5.1 In no case shall this insurance cover loss damage or expense arising from
unseaworthiness of vessel or craft,unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject‐matter insured,where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject‐matter insured is loaded therein
5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness ofthe ship to carry the subject‐matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness.
6.In no case shall this insurance cover loss damage or expense caused by
6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power
6.2 capture seizure arrest restraint or detainment, and the consequences thereof or any attempt thereat
6.3 derelict mines torpedoes bombs or other derelict weapons of war.
7.In no case shall this insurance cover loss damage or expense
7.1 caused by strikers, locked‐out workmen, or persons taking part in labour disturbances, riots or civil commotions
7.2 resulting from strikes, lock‐outs, labour disturbances, riots or civil commotions
7.3 caused by any terrorist or any person acting from a political motive.
DURATION
8.8.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either
8.1.1 on delivery to the Consignees’ or other final warehouse or place of storage at the destination named herein.
8.1.2 on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either
8.1.2.1 for storage other than in the ordinary course of transit or
8.1.2.2 for allocation or distribution,or on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the oversea vessel at the final port of discharge,whichever shall first occur.
8.2 If, after discharge overside from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.
8.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation,forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.
9.If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters,either
9.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur,or
9.2 if the goods are forwarded within the said period of 60 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.
10.Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.
CLAIMS
11.11.1 In order to recover under this insurance the Assured must have an insurable interest in the subject‐matter insured at the time of the loss.
11.2 Subject to 11.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.
12.Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject‐matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject‐matter to the destination to which it is insured hereunder.
This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 4, 5, 6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.
13.No claim for Constructive Total Loss shall be recoverable hereunder unless the subject0matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject‐matter to the destination to which it is insured would exceed its value on arrival.
14.14.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
14.2 Where this insurance is on Increased Value the following clause shall apply:
The agree value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured. In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
BENEFIT OF INSURANCE
15.This insurance shall not inure to the benefit of the carrier or other bailee.
MINIMISING LOSSES
16.It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder
16.1to take such measures as may be reasonable for the purpose of averting or minimising such loss, and
16.2to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised and the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.
17.Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject‐matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.
AVOIDANCE OF DELAY
18.It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.

19.This insurance is subject to English law and practice.
INSTITUTE CLASSIFICATION CLAUSE
INSTITUTE CLASSIFICATION CLAUSE
QUALIFYING VESSELS
1. This insurance and the marine transit rates as agreed in the policy or open cover apply only to cargoes and/or interests carried by mechanically self‐propelled vessels of steel construction classed with a Classification Society which is:
1.1 a Member or Associate Member of the International Association of Classification Societies (IACS*), or
1.2 a National Flag Society as defined in Clause 4 below, but only where the vessel is engaged exclusively in the coastal trading of that nation (including trading on an inter‐island route within an archipelago of which that nation forms part).
Cargoes and/or interests carried by vessels not classed as above must be notified promptly to underwriters for rates and conditions to be agreed. Should a loss occur prior to such agreement being obtained cover may be provided but only if cover would have been available at a reasonable commercial market rate on reasonable commercial market terms.
AGE LIMITATION
2. Cargoes and/or interests carried by Qualifying Vessels (as defined above) which exceed the following age limits will be insured on the policy or open cover conditions subject to an additional premium to be agreed.
Bulk or combination carriers over 10 years of age or other vessels over 15 years of age unless they:
2.1 have been used for the carriage of general cargo on an established and regular pattern of trading between a range of specified ports, and do not exceed 25 years of age, or
2.2 were constructed as containerships, vehicle carriers or double‐skin open‐hatch gantry crane vessels (OHGCs) and have been continuously used as such on an established and regular pattern of trading between a range of specified ports, and do not exceed 30 years of age.
CRAFT CLAUSE
3. The requirements of this Clause do not apply to any craft used to load or unload the vessel within the port area.
NATIONAL FLAG SOCIETY
4. A National Flag Society is a Classification Society which is domiciled in the same country as the owner of the vessel in question which must also operate under the flag of that country.
PROMPT NOTICE
5. Where this insurance requires the assured to give prompt notice to the Underwriters, the right to cover is dependent upon compliance with that obligation.

RISKS COVERED
1 .This insurance covers, except as provided in Clauses 4, 5, 6 and 7 below,
1.1 loss of or damage to the subject‐matter insured reasonably attributable to
1.1.1 fire explosion or heating, even when caused by spontaneous combustion, inherent vice or nature of the subject‐matter insured
1.1.2 vessel being stranded grounded sunk or capsized
1.1.3 collision or contact of vessel with any external object other than water
1.1.4 discharge of cargo at a port of distress
1.1.5 earthquake volcanic eruption or lightning,
1.2 loss of or damage to the subject‐matter insured caused by
1.2.1 general average sacrifice
1.2.2 jettison or washing overboard
1.2.3 entry of sea lake or river water into vessel hold container or place of storage.
2.This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 or elsewhere in this insurance. (General Average Clause)
3.This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment "Both to Blame Collision" Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim. ("Both to Blame Collision" Clause)

5.1.2 unfitness of container liftvan or land conveyance for the safe carriage of the subject‐matter insured, where loading therein is carried out prior to attachment of this insurance or by the Assured or their servants.
5.2 Where this insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject‐matter insured in good faith under a binding contract, exclusion 5.1.1 above shall not apply.
5.3 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject‐matter insured to destination.

The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
BENEFIT OF INSURANCE
15. This insurance shall not inure to the benefit of the carrier or other bailee.
MINIMISING LOSSES
16. It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder(Duty of Assured Clause)
16.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss, and
16.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised and the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.
17. Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject‐matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.
AVOIDANCE OF DELAY
18. It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.

19. This insurance is subject to English law and practice.
NOTE: It is necessary for the Assured when they become aware of an event which is "held covered" under this insurance to give prompt notice to the Underwriters and the right to such cover is dependent upon compliance with this obligation.

In the event of loss of or damage to any part or parts of an insured machine caused by a peril covered by the Policy the sum recoverable shall not exceed the cost of replacement or repair of such part or parts plus charges for forwarding and refitting, if incurred, but excluding duty unless the full duty is included in the amount insured, in which case loss, if any, sustained by payment of additional duty shall also be recoverable.
Provided always that in no case shall the liability of Underwriters exceed the insured value of the complete machine.

RISKS COVERED
1. This insurance covers, except as provided in Clause 2 below, loss of or damage to the subject‐matter insured caused by
1.1 strikers, locked‐out workmen, or persons taking part in labour disturbances, riots or civil commotions
1.2 any terrorist or any person acting form a political motive.
EXCLUSIONS
2. In no case shall this insurance cover
2.1 loss damage or expense attributable to wilful misconduct of the Assured
2.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject‐matter insured
2.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject‐matter insured (for the purpose of this Clauses 2.3 “packing” shall be deemed to include stowage in a container or liftvan but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)
2.4 loss damage or expense caused by inherent vice or nature of the subject‐matter insured
2.5 loss damage or expense arising from unfitness of aircraft conveyance container or liftvan for the safe carriage or the subject‐matter insured, where the Assured or their servants are privy to such unfitness at the time the subject‐matter insured is loaded therein
2.6 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against
2.7 loss damage or expense arising form insolvency or financial default of the owners managers charterers or operators of the aircraft
2.8 loss damage or expense arising form the absence shortage or withholding of labour of any description whatsoever resulting from any strike, lockout, labour disturbance, riot or civil commotion
2.9 loss damage or expense arising form the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force of matter
2.10 loss damage or expense caused by war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power.
DURATION
3.3.1 This insurance attaches form the time the subject‐matter insured leaves the warehouse, premises or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either
3.1.1 on delivery to the Consignees’ or other final warehouse, premises or place of storage at the destination named herein
3.1.2 on delivery to any other warehouse, premises or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either
3.1.2.1 for storage other than in the ordinary course of transit or
3.1.2.2 for allocation or distribution or
3.1.3 on the expiry of 30 days after unloading the subject‐matter insured from the aircraft at the final place of discharge, whichever shall first occur.
3.2 If, after unloading form the aircraft at the final place of discharge, but prior to termination of this insurance, the subject‐matter insured is forwarded to a destination other than that to which it is insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.
3.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 4 below) during delay beyond the control of the Assured, any deviation, forced discharge,reshipment or transhipment and during any variation of the adventure arising form the exercise of a liberty granted to the air carriers under the contract of carriage.
4. If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a place other than the destination named therein or the transit is otherwise terminated before delivery of the subject‐matter insured as provided for in Clause 3 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either
4.1 until the subject‐matter is sold and delivered at such place or, unless otherwise specially agreed, until the expiry of 30 days after arrival of the subject‐matter hereby insured at such place, whichever shall first occur,
4.2 if the subject‐matter is forwarded within the said period of 30 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 3 above.
5. Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.
CLAIMS
6.6.1 In order to recover under this insurance the Assured must have an insurable interest in the subjectmatter insured at the time of the loss.
6.2 Subject to 6.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.
7.7.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering theloss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
7.2 Where this insurance is on Increased Value the following clause shall apply:

where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject‐matter insured is loaded therein.
4.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject‐matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness of unfitness.
DURATION
5.5.1 This insurance attaches as the subject‐matter insured leaves tanks for the purpose of loading at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either
5.1.1 as the subject‐matter insured enters tanks on discharge to place of storage or to storage vessel at the destination named herein,or
5.1.2 on the expiry of 30 days after the date of arrival of the vessel at the destination named herein, whichever shall first occur.
5.2 If, after discharge from the oversea vessel into craft at the final port or place of discharge, but prior to the termination of this insurance under 5.1 above, the subject‐matter insured or any part thereof is to be forwarded to a destination other than that to which it is insured hereunder, the insurance on the subject‐matter insured or such part thereof shall not extend beyond the commencement of transit to such other destination, unless otherwise agreed by the Underwriters upon receipt of prompt notice from the Assured.
5.3 Subject to prompt notice being given to the Underwriters and to an additional premium if required by them, this insurance shall remain in force (until terminated under 5.1 or 5.2 above and subject to the provisions of Clause 6 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any other variation of the adventure provided such other variation is beyond the control of the Assured.
6. If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is terminated otherwise than as provided is Clause 5 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either
6.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiry of 30 days after arrival of the goods hereby insured at such port or place, whichever shall first occur,or
6.2 if the goods are forwarded within the said period of 30 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 5 above.
7. Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.

10. Claims for leakage and shortage recoverable under this insurance are to be adjusted as follows:
10.1 The amount recoverable shall be the proportionate insured value of the volume of oil lost, to be ascertained by a comparison of the gross volume certified as having left tanks for loading on to the vessel with the gross volume certified as having been delivered to tanks at the termination of the transit, except that where the contract of sale is based on weight and not on volume the amount recoverable may be calculated on a weight basis from such certified quantities.
The term "gross volume" in this Clause 10.1 means total volume without deduction of sediment and water content and free water, except to the extent that the amount of water can be shown by the Assured to have increased abnormally during the insured transit as a result of the operation of a risk covered by this insurance.
10.2 Adjustment shall be made to the calculation under 10.1 above to eliminate any change in volume caused by variation in temperature and any apparent change in quantity arising from the use of inconsistent procedures in determining the certified quantities.
10.3 Where this insurance provides for an excess to be applied to claims for leakage or shortage, such excess shall be deemed to include ordinary loss in weight or volume except when caused by variation in temperature or settling out of water. Where there is no such provision, the amount recoverable in accordance with Clauses 10.1 and 10.2 shall be subject to reduction for any ordinary loss excluded by Clause 3.2 above.

2.This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from a risk covered under these clauses.

5.5.1 This insurance
5.1.1 attaches only as the subject‐mater insured and as to any part as that part is loaded on an oversea vessel and
5.1.2 terminates, subject to 5.2 and 5.3 below, either as the subject‐matter insured and as to any part as that part is discharged from an oversea vessel at the final port or place of discharge, or on expiry of 15 days counting from midnight of the day of arrival of the vessel at the final port or place of discharge, whichever shall first occur. nevertheless, subject to prompt notice to the Underwriters and to an additional premium, such insurance
5.1.3 reattaches when, without having discharged the subject‐matter insured at the final port or place of discharge, the vessel sails therefrom,
5.1.4 terminates, subject to 5.2 and 5.3 below, either as the subject‐matter insured and as to any part as that part is thereafter discharged from the vessel at the final (or substituted) port or place of discharge, or on expiry of 15 days counting from midnight of the day of re‐arrival of the vessel at the final port or place of discharge or arrival of the vessel at a substituted port or place of discharge, whichever shall first occur.
5.2 If during the insured voyage the oversea vessel arrives at an intermediate port or place to discharge the subject‐matter insured for on‐carriage by oversea vessel or by aircraft, or the goods are discharged from the vessel at a port or place of refuge, then, subject to 5.3 below and to an additional premium if required, this insurance continues until the expiry of 15 days counting from midnight of the day of arrival of the vessel at such port or place, but thereafter reattaches as the subject‐matter insured and as to any part as that part is loaded on an on‐carrying oversea vessel or aircraft. During the period of 15 days the insurance remains in force after discharge only whilst the subject‐matter insured and as to any part as that part is at such port or place. If the goods are on‐carried within the said period of 15 days or if the insurance reattaches as provided in this Clause 5.2
5.2.1 where the on‐carriage is by oversea vessel this insurance continues subject to the terms of these clauses, or
5.2.2 where the on‐carriage is by aircraft, the current Institute War Clauses (Air Cargo) (excluding sendings by Post) shall be deemed to form part of this insurance and shall apply to the on‐carriage by air.
5.3 If the voyage in the contract of carriage is terminated at a port or place other than the destination agreed therein, such port or place shall be deemed the final port of discharge and such insurance terminates in accordance with 5.1.2. If the subject‐matter insured is subsequently reshipped to the original or any other destination, then provided notice is given to the Underwriters before the commencement of such further transit and subject to an additional premium, such insurance reattaches
5.3.1 in the case of the subject‐matter insured having been discharged, as the subject‐matter insured and as to any part as that part is loaded on the on‐carrying vessel for the voyage;
5.3.2 in the case of the subject‐matter not having been discharged, when the vessel sails from such deemed final port of discharge; thereafter such insurance terminates in accordance with 5.1.4.
5.4 The insurance against the risks of mines and derelict torpedoes, floating or submerged, is extended whilst the subject‐matter insured or any part thereof is on craft whilst in transit to or from the oversea vessel, but in no case beyond the expiry of 60 days after discharge from the oversea vessel unless otherwise specially agreed by the Underwriters.
5.5 Subject to prompt notice to Underwriters, and to an additional premium if required, this insurance shall remain in force within the provisions of these Clauses during any deviation, or any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.
(For the purpose of Clause 5“arrival”shall be deemed to mean that the vessel is anchored, moored or otherwise secured at a berth or place within the Harbour Authority area. If such a berth or place is not available, arrival is deemed to have occurred when the vessel first anchors, moors or otherwise secures either at or off the intended port or place of discharge“oversea vessel”shall be deemed to mean a vessel carrying the subject‐matter from one port or place to another where such voyage involves a sea passage by that vessel)
6. Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.
7. Anything contained in this contract which is inconsistent with Clauses 3.7, 3.8 or 5 shall, to the extent of such inconsistency, be null and void.

3 .This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment “Both to Blame Collision” Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim.
EXCLUSIONS
4. In no case shall this insurance cover
4.1 loss damage or expense attributable to willful misconduct of the Assured
4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject‐matter insured
4.3 loss damage or expense caused by inherent vice or nature of the subject‐matter insured
4.4 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)
4.5 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel
4.6 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
5 5.1 In no case shall this insurance cover loss damage or expense arising from unseaworthiness of vessel or craft, unfitness of vessel craft or conveyance for the safe carriage of the subject‐matter insured, where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject‐matter insured is loaded therein.
5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject‐matter insured to destination,unless the Assured or their servants are privy to unseaworthiness or unfitness
6 In no case shall this insurance cover loss damage or expense caused by
6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power
6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat
6.3 derelict mines torpedoes bombs or other derelict weapons of war.
7. In no case shall this insurance cover loss damage or expense
7.1 caused by strikers, locked‐out workmen, or persons taking part in labour disturbances, riots or civil commotions
7.2 resulting from strikes, lock‐outs, labour disturbances, riots or civil commotions
7.3 caused by terrorist or any person acting from a political motive.
DURATION
8.8.1 This insurance attaches as the subject‐matter insured leaves tanks for the purpose of loading at the place named herein for the commencement of the transit,continues during the ordinary course of transit and terminates either
8.1.1 as the subject‐matter insured enters tanks on discharge to place of storage or to storage vessel at the destination named herein, or
8.1.2 on the expiry of 30 days after the date of arrival of the vessel at the destination named herein, whichever shall first occur.
8.2 If, after discharge from the oversea vessel into craft at the final port or place of discharge, but prior to the termination of this insurance under 8.1 above,the subject‐matter insured or any part thereof is to be forwarded to a destination other than that to which it is insured hereunder, the insurance on the subject‐matter insured or such part thereof shall not extend beyond the commencement of transit to such other destination, unless otherwise agreed by the Underwriters upon receipt of prompt notice from the Assured.
8.3 Subject to prompt notice being given to the Underwriters and to an additional premium if required by them, this insurance shall remain in force (until terminated under 8.1 or 8.2 above and subject to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any other variation of the adventure provided such other variation is beyond the control of the Assured.
9. If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is terminated otherwise than as provided in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force,subject to an additional premium if required by the Underwriters, either
9.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiry of 30 days after arrival of the goods hereby insured at such port or place, whichever shall first occur, or
9.2 if the goods are forwarded within the said period of 30 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.
10. Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.
CLAIMS
11.11.1 In order to recover under this insurance the Assured must have an insurable interest in the subject‐matter insured at the time of the loss.
11.2 Subject to 11.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.
12 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject‐matter is covered under this insurance, the Underwriters will reimburse the
Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject‐matter to the destination to which it is insured hereunder.
This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 4, 5, 6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.
13 .No claim for Constructive Total Loss shall be recoverable hereunder unless the subject‐matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering,reconditioning and forwarding the subject‐matter to the destination to which it is insured would exceed its value on arrival.
14.14.1 If any Increased Value Insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering the loss, the liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
14.2 Where this insurance is on Increased Value the following clause shall apply:
The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurance.
15.Claims for leakage and shortage recoverable under this insurance are to be adjusted as follows:‐
15.1 The amount recoverable shall be the proportionate insured value of the volume of oil lost, to be ascertained by a comparison of the gross volume certified as having left tanks for loading on to the vessel with the gross volume certified as having been delivered to tanks at the termination of the transit, except that where the contract of sale is based on weight and not on volume the amount recoverable may be calculated on a weight basis from such certified quantities.
The term “gross volume” in this Clause 15.1 means total volume without deduction of sediment and water content and free water, except to the extent that the amount of water can be shown by the Assured to have increased abnormally during the insured transit as a result of the operation of a risk covered by this insurance.
15.2 Adjustment shall be made to the calculation under 15.1 above to eliminate any change in volume caused by variation in temperature and any apparent change in quantity arising from theuse of inconsistent procedures in determining the certified quantities.
15.3 Where this insurance provides for an excess to be applied to claims for leakage or shortage, such excess shall be deemed to include ordinary loss in weight or volume except when caused by variation in temperature or settling out of water. Where there is no such provision, the amount recoverable in accordance with Clauses
15.1 and 15.2 shall be subject to reduction for any ordinary loss excluded by Clause 4.2 above.
BENEFIT OF INSURANCE
16. This insurance shall not inure to the benefit of the carrier or other bailee.
MINIMISING LOSSES
17 It is the duty of Assured and their servants and agents in respect of loss recoverable hereunder.
17.1 to take such measures as may be reasonable for the purpose of loss recoverable loss, and
17.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised and the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.
18 .Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject‐matter insured shall not be considered as waiver or acceptance of abandonment or otherwise prejudice the rights of either party.
AVOIDANCE OF DELAY
19.It is a condition of this insurance that the Assured shall act with reasonable dispatch in all circumstances within their control.
LAW AND PRACTICE
20.This insurance is subject to English law and practice.

一、承保危险
(一)危险条款
除下列第(三)及第(四)条之规定以外,本保险承保因下列危险事故引起的保险标的物的灭失或损坏:
1. 因罢工工人、被迫停工工人或参与工潮、暴动或民众骚扰的人员引起者。
2. 因任何恐怖主义或任何政治动机而采取行动者造成的。
(二)共同海损条款
本保险承保依照运输合同、准据法和惯例理算或确定,为避免本(罢工险)保险下承保的损失而产生或与为避免该损失相关的共同海损与救助费用。
二、责任免除
(三)一般除外条款
本保险不承保下列各项损失及费用:
1. 因被保险人的故意不当行为所引起的灭失、损坏或费用。
2. 保险标的物之正常漏损、重量或体积的正常减少或自然耗损。
3. 保险标的物之包装或配制不良或不当引起的灭失、损坏或费用。(本项所指“包装”包括在集装箱或托盘内的堆放,但以此项堆放完成于本保险开始
前或由被保险人或其雇用人完成者为限。)
4. 保险标的物之固有瑕疵或性质引起的灭失、损坏或费用。
5. 因延迟直接造成的灭失、损坏或费用,即使延迟是由承保风险引起的(依以上第(二)条共同海损条款可予赔付的费用则不在此限)。
6. 由于船舶所有人、经理人、租船人或运营人的丧失偿债能力或逾期偿债引起的保险标的物的灭失、损坏或费用。
7. 因罢工、停工、工潮、暴动或民众骚扰结果引起任何情况之劳动力缺乏、不足或抵制引起的保险标的物的灭失、损坏或费用。
8. 任何由于航程或航行受阻所引起的索赔。
9. 任何因使用原子或核裂变和/或聚变或其类似反应或放射性力量或物质所制造的武器引起保险标的物之灭失、损坏或费用。
10. 因战争、内战、革命、叛乱、颠覆,或其引起之内争,或因交战方的敌对行为所造成的保险标的物的灭失、损坏和费用。
(四)不适航及不适运条款
1. 本保险在任何情况下都不承保下列事项所引起之灭失、损坏或费用:承运船舶或驳船不适航,及承运船舶、驳船、运输工具、集装箱或托盘不适合安全运送保险标的物,但此种不适航或不适运以被保险人或其受雇人于保险标的物装船时已知情者为限。
2. 除非被保险人或其受雇人对不适航或不适运已知情,保险人放弃任何违反载运船舶应具备适航能力及适运条件运送保险标的物至目的地的默示保证规定。
三、保险期间
(五)运输条款
1. 本保险自保险标的物离开本保险单所载起运地点的仓库或储存处所时开始生效,并于正常的运输过程中持续有效,于下述情形最早发生时终止:
1.1 交付至本保险单所载目的地之收货人的或其他最终仓库或储存处所,或
1.2 交付至本保险单所载目的地或中途之任何其他仓库或储存处所,而为被保险人用作:
1.2.1 正常运输过程以外之储存,或
1.2.2 保险标的物的分配或分装;或
1.3 至保险标的物自海轮在最终卸货港完全卸载后起算届满六十天。
2. 如保险标的物自海轮在最终卸货港卸载完毕后,但在本保险终止以前,被运往本保险单所载明目的地以外的其它目的地时,则本保险之效力,在仍受前述保险终止的约定限制的同时,应于该保险标的物开始运往其它目的地时起终止。
3. 本保险对于在被保险人无法控制的延迟、绕航、被迫卸载、重运或转船,以及船东或船舶租用人行使运输合同所授予的自由裁量权所作的任何航程变更期间继续有效(但仍受上述终止约定及以下第(六)条之限制)。
(六)运送终止条款
在被保险人无法控制的情形下,运输合同在原定目的港以外之港口或地点终止时,或保险标的物未能如前述第(五)条规定交货前运输即告终止时,本保险亦同时终止,除非被保险人立即通知保险人,及要求继续承保并同意缴付应加收之保险费,本保险继续有效至下述情形之一时为止:
1. 保险标的物已在该港或该地出售并交付,或者,除非另有特别约定,则以保险标的物自海轮抵达该港或该地届满六十天,二者以最先发生者为准。
2. 如保险标的物在六十天期限以内(或任何协议延长的期间内)运至本保险原定目的地或其它目的地,则本保险之效力,依上述第(五)条的约定终止。
(七)变更航程条款
本保险开始生效以后,如被保险人变更目的地,应立即通知保险人,本保险按另行确定的保险费暂予承保。
四、理赔事项
(八)保险利益条款
1. 被保险人在损坏发生保险标的物时,必须对保险标的物具有保险利益,始能要求本保险之赔偿。
2. 依据上述第(八)条第1款规定,即使损失发生于保险合同成立之前,除非被保险人已知该损失发生而保险人不知情,被保险人仍有权要求赔偿保险期间发生的属于本保险承保范围的损失。
(九)增值条款
1. 若被保险人对本保险项下的保险标的物安排了任何增值保险,则该保险标的物的协定价值应视为本保险与其它全部增值保险的保险金额之总和,而本保险项下之责任将按其保险金额占总保险金额之比例确定。索赔时,被保险人必须提供所有其它保险之保险金额的证明。
2. 本保险为增值保险时,必须适用下列条款:

五、保险权益

被保险人及其受雇人及代理人对在本保险项下可获得索赔的损失,应履行下列义务:
1. 遇有损失发生时或发生后,应采取适当之措施以合理防止或减轻损失,及
2. 应当保护与行使一切对抗承运人、受托人或其他第三人的权利。
保险人同意除本保险可得之任何损失赔偿外,对于被保险人为履行上述义务所作适当、合理支出之一切费用另予补偿。
(十二)放弃条款
被保险人或保险人为救助、保护或恢复保险标的物采取之措施,不得视为放弃或接受委付,或者以任何其它方式影响任何一方当事人的权益。
七、避免延迟
(十三)合理处置条款
被保险人在其所能控制的一切情形下,应作合理迅速之处理,为本保险之必要条件。
八、法律及惯例

本保险适用英国法律及惯例。

4. 在被保险人无法控制的情况下,运输合同在原定目的地以外的地点终止时,或因其他原因在保险标的物未能如前述第3条的约定交货前运输已告终止时,则本保险亦同时终止,除非被保险人立即通知保险人并要求继续承保险,并同意缴付应加收的保险费,则本保险继续有效至下述情形之一为止:
4.1 保险标的物已在该地出售并交付,或者,除非另有特别约定,则以保险标的物到达该地届满30天,二者以最先发生者为准。

9.2 应当保留及行使一切对抗承运人、受托人或其它第三方的权利。
保险人同意除本保险可得的任何损失赔偿外,对于被保险人为履行上述义务所作适当、合理支出之一切费用另予补偿。
10. 被保险人或保险人为救助、保护或恢复保险标的物所采取的措施,不得视为放弃或接受委付,或以任何其它方式损害任何一方当事人的权益。
避免迟延
11. 被保险人在其所能控制的一切情况下应作合理而迅速的处理,此为本保险的必要条件。
法律及惯例
12. 本保险适用英国法律及惯例。

承保风险
1. 本保险承保除下列3、4条以外,由下列原因造成的保险标的的损失或损害:
1.1 罢工者,被迫停工工人,或参与工潮,暴乱或民变的人员;
1.2 恐怖分子或出于政治动机而行为的人员;
2. 本保险承保根据运输合同、准据法和惯例理算或确定的共同海损和救助费用,其产生是为了避免由本条款所承保的风险造成的损失或与避免该损失有关。
除外责任
3. 本保险在任何情况下对下列不负赔偿责任:
3.1 可归咎于被保险人的蓄意恶行的损失、损害或费用;
3.2 保险标的的通常渗漏、重量或体积的正常损耗、自然磨损;
3.3 保险标的的本质缺陷或自然特性造成的损失、损害或费用;
3.4 直接由延迟引起的损失、损害或费用,即使延迟是由于承保风险引起的(但根据上述第2条可赔付的费用除外);
3.5 因船舶的所有人、经理人、承租人或经营人的破产或财务困境产生的损失、损害或费用;
3.6 由于任何罢工,被迫停工,工潮,暴乱或民变引起的劳动力缺乏、短缺或供应停止造成的损失、损害或费用;
3.7 任何基于航程受挫引起的损失;
3.8 因使用原子或核裂变和/或聚变或其他类似反应或放射性作用或物质所制造的战争武器造成的损失、损害或费用;
3.9 战争,内战,革命,叛乱,造反或由此引发的内乱,或由交战方做出的或针对交战方做出的任何敌对行为造成的损失、损害或费用。
4.1 在任何情况下,本保险对下列原因引起的损失、损害或费用不负赔偿责任:
船舶或驳船不适航;
船舶、驳船或运输工具不适宜保险标的的安全运输;
如果保险标的在装载的时候,被保险人或其受雇人对此种不适航或不适运有私谋;
4.2 保险人放弃船舶必须适航和适宜将保险标的运往目的地的默式保证,除非被保险人或其受雇人对此种不适航或不适宜的情况有私谋;
保险期间
5.1 本保险责任自保险标的在保单载明的启运地为装船而离开油罐时起生效,包括正常运输过程,终止于
5.1.1 保险标的进入油罐卸入保单载明目的地的储存处所或储存船舶,
或,
5.1.2 船舶抵达保单载明目的地满30天;
以上以先发生者为准。
5.2 如果保险标的在最终卸货港或地点卸离海轮至驳船后,但在根据上述5.1项所述本保险终止之前,保险标的或任何一部分运至非保单载明目的地,本保险对保险标的或此部分自开始运往非保单载明目的地时起不再扩展承保,除非保险人在接到被保险人及时通知后同意承保;
5.3 在保险人接到及时通知并加收保费(如果需要)的情况下,如发生被保险人无法控制的延迟,绕行,被迫卸货,重新装载或转运,以及任何其他被保险人无法控制的航海变更,本保险继续有效(直至上述5.1和5.2规定的终止和下述第6条规定的制约);
6. 如果由于被保险人无法控制的情况,运输合同在载明的目的地以外的港口或地点终止,或运送在如同上述第5条规定的交付货物前另行终止,那么本保险也终止,但若迅速通知了保险人并在本保险仍有效时提出继续承保的要求,并在必要时加缴保险费的情况下,本保险继续有效;
6.1 直至货物在此种港口或地点出售并交付,或者,除非另有特别约定,直至保险货物到达该港口或地点满60天,二者以先发生者为准,
或者,
6.2 如果货物在上述60天(或任何约定的延展期间)内被运往载明的目的地或其他目的地,直至根据上述第5条的规定而终止。
7. 如果在本保险责任开始后,被保险人变更目的地,经另行商定保险费和保险条件,本保险仍然有效,但以迅速通知保险人为前提。
索赔
8.1 在发生损失时,被保险人必须对保险标的具有可保利益,才能获得本保险单项下的赔偿;
8.2 被保险人有权按照上述11.1条的规定,对在本保险期间内发生的承保损失获得赔偿,即使损失发生在订立保险合同之前.但在订立保险合同时被保险人已经知悉损失,而保险人不知情者除外;
9.1 如果被保险人对本保单项下承保的货物办理任何增值保险,则货物的约定价值应视为增至本保险的保险金额加上所有承保该项损失的增值保险的保险金额的总和.本保险的责任按照本保险金额与总保险金额的比例计算;
被保险人提出索赔时,应向保险人提供所有其他保险的保险金额的证明;
9.2 当本保险承保增值保险时,适用下列条款:
货物的约定价值应视为等于原有的保险单项下的总保额和被保险人对该项损失投保所有增值保险的保险金额的总和.本保险应按其保险金额在总保险金额中的比例承担赔偿责任;
被保险人提出索赔时,应向保险人提供所有其他保险的保险金额的证明;
10. 根据本保险可获保险赔偿的渗漏和短少索赔,按照下列规定理算:
10.1 赔偿金额应为,将离开油罐装船的油的总容量与运送结束时卸到油罐中的油的总容量相减,所损失的油的容量所占的保险价值,但如果销售合同是基于重量而不是容量,则赔付金额应以重量为基础计算;
本条中“总容量”是指未扣除沉积物,水份以及游离水的总容量,除非被保险人可以证明含水量在运输途中由于本保险承保风险而异常增加了;
10.2 对于按照上述10.1条项下的计算,应当进行调整,以消除温度的不同造成容量的变化和在确定重量时由于采用不一致的程序造成的重量的明显变化;
10.3 当本保险规定渗漏和短少的免赔时,该免赔应视为包括重量或容量的通常损耗,但不包括温度变化及水份减少引起的损失.如果没有免赔的规定,按照10.1和10.2计算的赔付金额须受上述3.2条中规定除外的正常损耗的限制。
保险受益
11. 承运人或其他受托人不得享受本保险的利益;
12. 就本保险承保的损失而言,被保险人及其受雇人和代理人,有义务减少损失:
12.1 采取合理措施,以避免或减小该损失并
12.2 保证对承运人,受托人或其他第三方的追偿权被适当的保留和行使;
保险人除赔偿责任范围内的损失以外,还应偿付被保险人为履行上述义务产生的任何适当和合理的费用;
13. 被保险人或保险人为施救,保护或恢复保险标的所采取的措施,不应视为放弃或接受委付的表示,或在其他方面损害任何一方的权益;
防止延误
14. 本保险的条件之一是被保险人应在任何情况下,在其控制的范围内尽快合理采取行动。

协会船级条款
船级社合格的船舶
1. 本保险单或预约报单所约定的保险和海上运输保险费率仅适用于加入以下船级社的钢质自航船所载的货物:
1.1 国际船级社协会的成员
1.2 条款4中所定义的国旗船级社,但是这些船舶应仅从事该国沿海运输(包括从事该国所属的岛屿之间的运输)
不在上述船级范围的船舶所承运的货物应立即通知保险人,并得到保险人对费率和条件的同意。对与保险人达成协议前发生的损失的保障,仅限于根据合理的市场费率和合理的市场条款可行的范围。
船龄限制2由上述合格船舶所承运的货物,若承运船舶船龄超过以下的限制,在被保险人支付额外保费的前提下,本保险或预约保险仍然有效:
散装货船、多用途货船船龄超过10年,其它类型船舶船龄超过15年,除非是:
2.1 在特定范围的港口之间从事固定的、有规律的杂货贸易运输,船龄不超过25年,或
2.2 集装箱船、滚装船或双壳开口龙门吊机船,一直在特定范围的港口间从事固定的、有规律的贸易运输,船龄不超过30年。
驳船条款
3. 本条款的要求不适用于在港口区域对船舶进行装卸操作的驳船

4. 国旗船级社是指位于船舶的船籍所在国的船级社;

一、承保风险
1. 本保险承保除以下4,5,6,7条除外责任以外的下列风险;
1.1 保险标的合理归因于下列风险所致的损失或损害:
(一)火灾或爆炸;
(二)船舶或驳船搁浅,触礁,沉没或倾覆;
(三)陆上运输工具的翻倒或出轨;
(四)船舶、驳船或运输工具与除水以外的其他外来物体碰撞或触碰;
(五)在避难港卸货;
1.2 由下列原因造成的保险标的的损失或损害
(一)共同海损牺牲;
(二)抛弃或浪击落海;
(三)海水、湖水或河水进入船舶、驳船、船舱、运输工具、集装箱、托盘或储存处所;
1.3 货物在船舶或驳船装卸时落海或跌落造成任何整件的全损;
2. 本保险承保根据运输合同、准据法和惯例理算或确定的共同海损和救助费用,其产生是为了避免任何原因造成的损失或与避免任何原因造成的损失有关,但此种原因须不是本保险第4,5,6,7条或其他条文除外的危险;
3. 本保险扩展赔偿被保险人根据本保险可补偿的损失方面根据运输合同中的“双方有责碰撞”条款的比例责任部分。在船东根据此条款提出索赔的情况下,被保险人同意通知保险人,保险人有权自负费用为被保险人对此种索赔提出抗辩。
二、除外责任
4. 本保险在任何情况下不承担:
4.1 可归咎于被保险人的蓄意恶行的损失、损害或费用;
4.2 保险标的重量或体积的正常损耗、自然磨损;
4.3 保险标的的包装或准备不足或不当引起的损失、损害或费用(本条所称“包装”应视为包括集装箱或托盘内的积载,但仅适用于此种积载是在本保险责任开始前进行或是由被保险人或其雇员进行之时);
4.4 保险标的的本质缺陷或自然特性造成的损失、损害或费用;
4.5 直接由延迟引起的损失、损害或费用,即使延迟是由于承保风险引起的(但根据上述第2条可赔付的费用除外);
4.6 因船舶的所有人、经理人、承租人或经营人的破产或财务困境产生的损失、损害或费用而在保险标的装上船舶的时候,被保险人知道或在正常的业务情况下应当知道此种破产或财务困境有可能阻碍航程的正常进行。如本保险根据有效合同被转让给已经购买或已经同意购买保险标的的善意的一方时,根据本保险提出索赔时本条除外责任不适用;
4.7 因使用原子或核裂变和/或聚变或其他类似反应或放射性作用或物质所制造的战争武器造成的损失、损害或费用;
5.1 本保险在任何情况下不负责赔偿下列原因造成的损失、损害或费用;
船舶,驳船不适航或不适合保险标的的安全运输,而被保险人在保险标的装载时对此种不适航或不适运有私谋集装箱,托盘或陆地运输工具不适合安全运载保险标的,而此装载是于本保险责任开始之前完成或是由被保险人或其受雇人完成
5.2 如本保险根据有效合同被转让给已经购买或已经同意购买保险标的的善意的一方时,根据本保险提出索赔时上述5.1.1除外责任不适用;
5.3 保险人放弃船舶适航或适合安全运输保险标的至目的地的默式保证;
6. 本保险在任何情况下对下列原因造成的损失、损害或费用不负赔偿责任;
6.1 战争,内战,革命,叛乱,造反或由此引发的内乱,或由交战方做出的或针对交战方做出的任何敌对行为;
6.2 捕获,没收,拘留,禁止,扣押(海盗行为除外),以及此种行为的后果或这方面的企图;
6.3 被遗弃的水雷,鱼雷,炸弹或其他被遗弃的战争武器;
7. 本保险在任何情况下对下列原因造成的损失、损害或费用不负责赔偿;
7.1 由罢工者,被停工工人,或参与工潮,暴动或民变的人员造成;
7.2 罢工,被停工,工潮,暴动或民变引起;
7.3 任何恐怖主义者或出于政治目的采取行动的任何人造成。
三、保险期间
8.1 本保险自货物在保单载明港口或地点装上海轮开始运输时生效,包括正常运输过程,终止于交付至保单载明目的地收货人的或其他最终仓库或储存处所,交付至保单载明目的地之前或目的地的任何其他仓库或储存处所,由被保险人选择用作:通常运输过程之外的储存或分配或分派被保险货物在最终卸货港口全部卸离海轮后满30天,以上各项以先发生者为准;
8.2 如果在最后卸货港卸离海船后,但在本保险终止之前,货物被发送到非本保险承保的目的地,本保险,在依然受前述规定的终止所制约的同时,截止于开始向此种其他目的地运送之时;
8.3 在被保险人无法控制的迟延、任何绕航、强制卸货、重装或转运期间,以及船东或承租人行使根据运输合同赋予的自由权产生的任何航海上的变更期间,本保险继续有效(但须受上述规定的终止和下述第9条规定的制约);
9. 如果由于被保险人无法控制的情况,运输合同在载明的目的地以外的港口或地点终止,或运送在如同上述第8条规定的交付货物前另行终止,那么本保险也终止,但若迅速通知了保险人并在本保险仍有效时提出继续承保的要求,并在必要时加缴保险费的情况下,本保险继续有效;
9.1 直至货物在此种港口或地点出售并交付,或者,除非另有特别约定,直至保险货物到达该港口或地点满15天,二者以先发生者为准;
9.2 如果货物在上述15天(或任何约定的延展期间)内被运往载明的目的地或其他目的地,直至根据上述第8条的规定而终止;
10. 如果在本保险责任开始后,被保险人变更目的地,经另行商定保险费和保险条件,本保险仍然有效,但以迅速通知保险人为前提。
四、索赔
11.1 在发生损失时,被保险人必须对保险标的具有可保利益,才能获得本保险单项下的赔偿;
11.2 被保险人有权按照上述11.1条的规定,对在本保险期间内发生的承保损失获得赔偿,即使损失发生在订立保险合同之前.但在订立保险合同时被保险人已经知悉损失,而保险人不知情者除外;
12. 由于本保险承保风险致使被保险之运输在非保单载明港口或地点终止,保险人负责偿付被保险人在卸货,存仓和续运保险标的至保单载明目的地适当而合理产生的额外费用。本条不适用于共同海损或救助费用,并须受上述4,5,6,7条除外责任的制约,且不包括由于被保险人或其受雇人的过失,疏忽,破产或财务困境而引起的费用;
13. 本保险对推定全损不负责赔偿,除非保险标的的实际全损已经不可避免或者因为恢复、重新整理和续运保险标的至保单载明目的地的费用将超过其抵达目的地的价值,并且保险标的被合理委付;
14.1 如果被保险人对本保单项下承保的货物办理任何增值保险,则货物的约定价值应视为增至本保险的保险金额加上所有承保该项损失的增值保险的保险金额的总和.本保险的责任按照本保险金额与总保险金额的比例计算。被保险人提出索赔时,应向保险人提供所有其他保险的保险金额的证明;
14.2 当本保险承保增值保险时,适用下列条款:货物的约定价值应视为等于原有的保险单项下的总保额和被保险人对该项损失投保所有增值保险的保险金额的总和。本保险应按其保险金额在总保险金额中的比例承担赔偿责任。被保险人提出索赔时,应向保险人提供所有其他保险的保险金额的证明。
五、保险受益
15. 承运人或其他受托人不得享受本保险的利益。

16. 就本保险承保的损失而言,被保险人及其受雇人和代理人,有义务:

协会航空运输保险(邮递运输除外)
承保风险
1. 本保险承保保险标的物毁损或灭失之一切危险;但下列第2.3.和4.条另有规定者除外。
除外事项
2. 本保险在任何情况下均不承保下列事项:
2.1 归因于被保险人之故意不当行为所致之毁损灭失或费用。
2.2 保险标的物之正常漏损、重量或容量之正常减少或自然耗损。
2.3 由于保险标的物之包装或配置不固或不当所致之毁损,灭失或费用(本条款2.3所指之「包装」包括集装箱或底盘内之堆放,但此项堆放以完成于本保险生效前或由被保险人或其受雇人所为者为限)。
2.4 由于保险标的物之内在瑕庇或性质所致之毁损灭失或费用。
2.5 由于飞机装运的集装箱或底盘不适合安全装运被保货物且被保险人在装运时知道这些不适之处所致的被保货物毁损及失灭和引起的费用。
2.6 直接由于迟延所致之毁损、灭失或费用,即使此项迟延系因承保危险所致者。
2.7 因航空运载工具所有人、承租人、经理人或营运人之无力偿债或财务失信所引起之毁损灭失和引起的费 用。
2.8 由于使用核子分裂或融合或其他类似反应或放射能,放射性物质之武器所引起毁损灭失或费用。
3. 本保险不承保下列事项所致之毁损灭失或费用。
3.1 战争、内战、革命、叛乱、颠覆或因而引起之内乱,或来自交战国或其对抗之敌对行为。
3.2 捕获、扣押、拘管、禁止或扣留(海盗除外)及其结果,或任何此项之企图。
3.3 遗弃之水雷、鱼雷、炸弹或其他兵器。
4. 本保险不承保下列事项所致之毁损灭失或费用:
4.1 由于罢工工人、停工工人或参与劳工骚扰、暴动或内乱之人所致者。
4.2 因罢工、停工、劳工骚扰、暴动或内乱所产生者。
4.3 由于任何恐怖份子或因政治动机之行为所致者。
保险期间
5.1 本保险自货物离开本保险单所载地点之仓库或储存处所开始运输时生效,经正常之运送过程,以迄下述之一时为止:
5.1.1 货物交付至本保险单所载目的地收货人所属或其他最终之仓库或储存处所。
5.1.2 无论是在到达本保险单所载目的地之前还是在目的地其他由被保险人选择使用的任何之最终之仓库或储存处所,用于:
5.1.2.1 正常运送过程以外之储存;或
5.1.2.2 货物之分配或分发;或
5.1.2.3 被保险货物于最终卸货地自飞机卸货完毕之日起届满30天,以上三种终止情形以孰先发生者为准。
5.2 如被保险货物自飞机于最终卸货机场卸载完毕后,而在本保险尚未终止时,欲再运往本保险单所载以外之其他目的地时,本保险之效力仍受前述保险终止约定之限制,但应于该项货物开始再运往其他目的地时终止。
5.3 本保险对于非由被保险人所能控制之迟延、偏航、被迫卸货、重运或转机,以及飞机承运人或飞机租用人依据运送契约授权自由裁量而产生之任何航程变更期间继续有效(但仍受上述终止之约定,及以下第6条之限制)。
6. 在被保险人无法控制情况下,运送契约在原定目的机场以外之机场或地点终止,或因其他缘故在货物未能如前述第5条之约定交货前该运送即告终止时,则本保险亦同时终止,但保险人立即接获被保险人通知并被要求继续保险效力,并于必要时加收保险费,则本保险仍得有效,以迄下列情形之一者为止:
6.1 货物已在该机场或该运输终止地出售并交付,或,除非另有其他特别约定,在被保险货物到达该机场或该运输终止地届满30天,二者以孰先发生者为准。
6.2 如货物在上述30天内(或在任何协议延长之期间内)运往本保险所定其他目的地时,本保险之效力依上述第5条之约定终止。
7. 本保险生效后,如被保险人变更目的地,应立即通知保险人,使本保险继续有效,但须另行确定保险费及条件。
理赔
8.1 被保险人在损害发生时,须对保险标的物具有保险利益,始能要求本保险之赔偿。
8.2 依上述8.1之约定,被保险人对保险期间内所发生之保险标的物的损失,有权利要求赔偿,即使损害发生于保险契约签订之前亦同,但被保险人知道损害已经发生而保险人不知者,则不在此限。
9. 由于本保险所承保危险之发生,致使被保险航程在本保单所载明以外之机场或地点终止时,被保险人因卸货、转运费用条款储存及转运保险标的物至保单所载明目的地,其所支出之适当而合理之一切额外费用,保险人同意予以补偿。
本条款不适用于共同海损或救助费用,除仍须受上述2.3.4.除外条款。
10. 除非保险标的物之实际全损显已无法避免,或其恢复、整修及运送原承保目的地之费用,势将超过其抵达后之价值而经合理委付者,被保险人不得以推定全损请求赔偿。
11.1 若被保险人对本保险之货物投保增值保险时,该货物协议价值应视为本保险与增值保险的保险金额之总和,增值保险条款而本保险之责任则按其保险金额占上述保险总金额之比例分担之。索赔时被保险人须向保险人提出所有其他保险有关保险金额之证明。
11.2 本保险为增值保险时,必须适用下列条款:被保险人投保同一损害危险之增值保险,该货物协议价值应视为原保险与全部增值保险二者保险金额之总和,而本保险之责任则按其保险金额占上述保险总金额之比例分担之。索赔时被保险人须向保有其他保险有关保险金额之证明。
保险之利益
12. 承运人或其他受托人不得享用本保险之利益。
损害之减轻
13. 被保险人及其受雇人及代理人对本保险之可赔损害,应尽下列义务:
13.1 应采取避免或减轻上述损害之适当措施;及
13.2 对于承运人、受托人或其他第三者之一切对抗权利应予适当保留及行使。保险人同意除本保险可得之任何损害赔偿外,对于被保险人为履行上述义务所作适当,合理支出之一切费用另予补偿。
14. 被保险人或保险人为救助、保护或恢复保险标的物所采取之措施,不得视为对委付之放弃或承诺,或影响任何一方当事人之权益。
迟延之避免
15. 被保险人在其所能控制之一切情况下应作合理而迅速之处理,为本保险之必要条件。

1.2 由下列原因造成的被保险标的的损失或污染
1.2.1 共同海损牺牲
1.2.2 抛弃
1.2.3 装载、转运或卸载时从连接管线的渗漏
1.2.4 船长或船员在抽吸货物、压载水或燃油时的疏忽,
1.3 由于恶劣天气造成的保险标的污染。
2. 本保险承保根据运输合同、准据法和惯例理算或确定的共同海损和救助费用,其产生是为了避免任何原因造成的损失或与避免任何原因造成的损失有关,但此种原因须不是本保险第4,5,6,7条或其他条文除外的危险。
3. 本保险扩展赔偿被保险人根据本保险可补偿的损失方面根据运输合同中的“双方有责碰撞”条款的比例责任部分。在船东根据此条款提出索赔的情况下,被保险人同意通知保险人,保险人有权自负费用为被保险人对此种索赔提出答辩。
除外责任
本保险决不承担
4.1 可归咎于被保险人的蓄意恶行的损失、损害或费用
4.2 保险标的的通常渗漏、重量或体积的正常损耗、自然磨损
4.3 保险标的的本质缺陷或自然特性造成的损失或费用
4.4 直接由延迟引起的损失或费用,即使延迟是由于承保风险引起的(除非是在上述第2条项下可赔付的费用)
4.5 因船舶的所有人、经理人、承租人或经营人的破产或经济困境产生的 损失、损害或费用
4.6 因使用任何原子或核子裂变和/或聚变或其他类似反应或放射性作用或放射性物质的战争武器造成的损失和费用。
5.1 本保险在任何情况下对下列原因引起的损失、损害或费用不负赔偿责任:
船舶或驳船不适航,
船舶或运输工具不适宜保险标的的安全运输
而且在保险标的装于其上时,被保险人或其雇员对此种不适航或不适运有私谋。
5.2 保险人放弃船舶必须适航和适宜将保险标的运往目的地的默式担保,除非被保险人或其受雇人对此种不适航或不适宜的情况有私谋。
6. 本保险在任何情况下对下列原因造成的损失或费用不负赔偿责任
6.1 战争、内战、革命、造反、叛乱或由此引起的内乱或交战双方之间的敌对行为
6.2 捕获,没收,扣留,扣押,禁止(海盗行为除外),以及此种行为的后果或这方面的企图
6.3 被弃置的水雷,鱼雷,炸弹或其他被弃置的战争武器。
7. 本保险在任何情况下对下列原因造成的损失或费用不负赔偿责任
7.1 由罢工者,被停工工人,或参与工潮,暴动或民变的人员造成者
7.2 罢工,被停工,工潮,暴动或民变造成者
7.3 恐怖分子或任何出于政治动机而行为的人员造成者。
保险期限
8.1 本保险责任自保险标的在保单载明的启运地为装船而离开油罐时起 生效,包括正常运输过程,终止于
8.1.1 保险标的进入油罐卸入保单载明目的地的储存处所或屯船,或者
8.1.2 船舶抵达保单载明目的地满30天,以上以先发生者为准。
8.2 如果保险标的在到达上述8.1项所述保单目的地之前,在最终卸货港或地点卸离海轮至驳船,保险标的或任何一部分运至非保单载明目的地,本保险对保险标的或此部分自开始运往非保单载明目的地时起不再扩展承保,除非保险人在接到被保险人及时通知后同意承保。
8.3 在保险人接到及时通知并加收保费(如果需要)的情况下,如发生被保险人无法控制的的延迟,绕行,被迫卸货,重新装载或转运,以及任何其他被保险人无法控制的航海变更,本保险继续有效(直至上述8.1和8.2情况下终止并限于下面第9条的规定)。
9. 如果由于被保险人无法控制的情况,致使运输合同在载明的目的地以外的港口或地点终止,或运送在如同上述第8条规定的交付货物前另行终止,那么本保险也终止,但若迅速通知了保险人并在本保险仍有效时提出继续承保的要求,并在必要时加缴保险费的情况下,本保险继续有效
9.1 直至货物在该港口或处所出售并交货,或,除非有特别约定,在被保险货物抵达该港口或处所后满30天为止,以先发生者为准,或者
9.2 如果货物在上述30天期限内(或任何约定延长期限)被运往保单载明目的地或任何其他目的地,保险期限按照上述第8条的规定终止。
10. 如果在本保险责任开始后,被保险人变更目的地,经另行商定保险费和保险条件,本保险仍然有效,但以立即通知保险人为前提。
索赔
11.1 被保险人在发生损失时必须对保险标的须具有可保利益,才能获得本保险单项下的赔偿。
11.2 被保险人有权按照上述11.1条的规定,对在本保险期限内发生的承保损失获得赔偿,即使损失发生在订立保险合同之前.但在订立保险合同时被保险人已经知悉损失而保险人不知情者除外。
12. 由于本保险承保风险致使被保险之运输在非保单载明港口或地点处所终止,保险人负责偿付被保险人在卸货,存仓和续运保险标的至保单载明目的地适当而合理产生的额外费用。
本条款不适用于共同海损或救助费用,并须按照上述4,5,6,7条除外责任的规定处理,且不包括由于被保险人或其受雇人的过失,疏忽,破产或经济困境而引起的费用。
13.本保险对推定全损不负责赔偿,除非保险标的的实际全损已经不可避免或者因为恢复,重新整理和续运保险标的至保单载明目的地的费用将超过其抵达目的地的价值,并且保险标的被合理委付。
14.1 如果被保险人对本保单项下承保的货物办理任何增值保险,则货物的保险价值应视为增至本保险的保险金额加上所有承保该项损失的增值保险的总和.本保险的责任按照本保险金额与总保险金额的比例计算。
被保险人提出索赔时,应向保险人提供所有其他保险单的保险金额的证明。
14.2 当本保险承保增值保险时,适用下列条款:
货物的保险价值应视为等于原有的保险单项下的总保额和被保险人对该项损失投保所有增值保险额的总和.本保险应按其保险金额在总保险金额中的比例承担赔偿责任。
被保险人提出索赔时,应向保险人提供所有其他保险单的保险金额的证明。
15. 根据本保险可获保险赔偿的渗漏和短少索赔,按照下列规定理算:
15.1 赔偿金额应为,将离开油罐装船的油的总容量与运送结束时卸到油罐中的油的总容量相减,所损失的油的容量所占的保险价值,但如果销售合同是基于重量而不是容量,则赔付金额应以重量为基础计算。
本条中“总容量”是指未扣除沉积物,水份以及游离水的总容量,除非被保险人可以证明含水量在运输途中由于本保险承保风险而异常增加了。
15.2 对于按照上述15.1条项下的计算,应当进行调整,以消除温度的不同造成容量的变化和在确定重量时程序的不一致造成的重量的明显变化。
15.3 当本保险规定渗漏和短少的免赔时,该免赔应视为包括重量或容量的通常损耗,温度变化及水份减少引起的除外.如果没有免赔的规定,按照15.1和15.2计算的赔付金额须受上述4.2条款中规定除外的正常损耗的限制。
保险利益
16. 承运人或其他受托人不得享受本保险的利益。
减少损失
17. 就本保险承保的损失而言,被保险人及其雇员和代理人,有义务
17.1 采取合理措施,以避免或减小该损失,并且
17.2 保证对承运人,保管人或其他第三方的追偿权被适当的保留和行使而保险人负责在可取得赔偿的损失之外补偿被保险人履行这些义务而适当和合理地招致的任何费用。
18. 被保险人和保险人采取的旨在拯救、保护或恢复保险标的的措施不得视为放弃或接受委付或在其他方面损害任何一方的权利。
避免迟延
19. 本保险的条件之一是被保险人在所有其力所能及的情况下合理迅速地行动。
法律和惯例
20. 本保险受英国法律和惯例管辖。
注意:被保险人在知悉本根据本保险单“续保”的事件发生时有必要向保险人发出迅速的通知,此种承保的权利取决于履行这项义务。
协会货物战争险条款
一、 承保危险
1. 危险条款
除下列第3及4条规定的情形外,本保险承保因下列危险事故引起的保险标的物的灭失或损害:
1.1 因战争、内战、革命、叛乱、颠覆,或其引起之内争,或因交战国引起的或对交战国发起的一切敌对行为。
1.2 由上述第1.1项承保的危险产生的捕获、扣押、拘捕、限制或扣留,及上述各项行动的后果或任何威胁企图采取上述各项行动。
1.3 废弃的水雷、鱼雷、炸弹或其他武器。
2. 共同海损条款
本保险承保依据运输合同、准据法及惯例理算或确定的,为避免本(战争险)保险下承保的损失而产生或与为避免该损失相关的共同海损与施救费用。
二、 责任免除
3. 一般除外条款
本保险在任何情况下都不承保下列各项灭失、损害及费用:
3.1 因被保险人的故意不当行为所引起的灭失、损害或费用。
3.2 保险标的物之正常漏损、重量或体积的正常减少或自然耗损。
3.3 保险标的物包装或配制不良或不当而引起的灭失、损害或费用。(本款所指的“包装”包括在集装箱或托盘内之堆放,但以此项堆放完成于本保险开始前或由被保险人或其雇佣人完成者为限。)
3.4 保险标的物之固有瑕疵或性质引起的灭失、损害或费用。
3.5 因延迟直接造成的灭失、损坏或费用,即使延迟是由承保风险引起的。(依第2条共同海损条款可予赔付的费用则不在此限。)
3.6 由于船舶所有人、经理人、租船人或营运人的丧失偿债能力或逾期偿债引起的灭失、损坏或费用。
3.7 任何由于航程或航行受阻引起的索赔。
3.8 任何使用原子核裂变和/或聚变或其它类似反应或放射性力量或物质所制造的武器引起保险标的物之灭失、损坏或费用。
4. 不适航及不适运条款
4.1 本保险在任何情况下都不承保下列事项所引起之灭失、损坏或费用:承运船舶或驳船不适航,及承运船舶、驳船、运输工具、集装箱或托盘不适合安全运送保险标的物,但此种不适航或不适运以被保险人或其受雇人于保险标的物装船时已知情者为限。
4.2 除非被保险人或其受雇人对不适航或不适运已知情,保险人放弃追究违反承运船舶应具备适航能力及适运条件运送保险标的物至目的地默示保证规定。
三、 保险期间
5. 运输条款
5.1.1 自保险标的物或其任何部分被装载于海轮上后开始生效,
5.1.2 除下列第5.2项及第5.3项另有约定外,于保险标的物或其任何部分在最后卸载港或卸货地从海轮卸下后,或自海轮到达最后卸载港或卸货地的当日午夜开始起算届满十五天后终止,以上述先发生者为准;但是经被保险人立即通知保险人并加付额外之保险费,本保险效力得于
5.1.3 当保险标的物未能在最后卸载港或卸货地卸下,海轮又从该卸载港或卸货地启航时恢复,并
5.1.4 除下列第5.2项及第5.3项另有约定外,在保险标的物或其任何部分嗣后于最后卸载港(或替代港)或卸货地从海轮卸下后,或自海轮再到达最后卸载港或卸货地或海轮到达替代港或卸货地之当日午夜开始起算届满十五天终止,以上述先发生者为准。
5.2 如于被保险航程中,保险标的物在中途港或中转地自海轮卸下,再由另一艘海轮或飞机继续承运,或该保险标的物在避难港或避难地被从海轮卸下,则依据下列第5.3项,并经要求加付额外保险费后,本保险自海轮到达该该等港口或地点当日午夜开始起算届满十五天后终止,但于保险标的物重新装载上海轮或飞机时重新恢复效力。在上述卸载后十五天内,本保险仅对保险标的物或其任何部分在该港口或地点期间继续有效。如保险标的物在上述十五天内被继续运送或本保险效力依本第5.2项再行恢复时,
5.2.1 如由海轮继续运送,本保险继续适用本条款的规定。
5.2.2 如由飞机继续运送,则本保险应视为包含现行协会战争险条款(空运货物)(不包括邮包寄送),该条款应适用于空运转运阶段。
5.3 如运输合同因故在保险单载明之目的地以外之港口或地点终止时,则该港口或地点将被视为最后港或卸载港,本保险之效力即依据本第5.1.2款之规定终止。如保险标的物其后重新装运至原目的地或其它目的地,而被保险人于此转运开始前即通知保险人并加付额外保险费,本保险效力将于下列情况下重新恢复:
5.3.1 如保险标的物已被卸下,当保险标的物或其任何部分被装载于海轮上驶往原目的地时;或
5.3.1 如保险标的物未被卸下,当海轮从被视为最终卸载港的地方启航时;其后本保险效力即依据本第5.1.4款之规定终止。
5.4 本保险承保漂浮或沉没于水面之下的水雷及遗弃鱼雷之危险,扩展至保险标的物或其任何部分为装船或卸船之目的而被装载于驳船上运输的期间,但除保险人特别同意外,该保障绝不超过自海轮卸载后届满六十天。
5.5 在被保险人立即通知保险人并按保险人要求加付额外保险费的前提下,在任何绕航或任何由于船东或船舶租用人行使运输合同所授予的自由裁量权而作的航程变更期间,本保险继续有效。本条款所称的“到达”是指船舶在港务当局管辖区域内抛锚、停泊或以其他方式固定在某一泊位或地点。如果没有此种泊位或地点,则当船舶首次抛锚、停泊或系泊在或离开预定卸载港口或地点将被视为已到达。“海轮”是指装运保险标的物从一处港口或地点经过海上航程而航行至另一处港口或地点之船舶。
6. 变更航程条款
本保险生效本保险生效以后,如被保险人变更目的地,应立即通知保险人,本保险按另行确定的保险费和条件暂予承保。
7. 凡本保险合同所载任何内容有与第3.7款、第3.8款或第5条不一致者,均属无效。
四、 理赔事项
8. 保险利益条款
8.1 被保险人在损害发生时,必须对保险标的物具有保险利益,才能要求本保险之赔偿。
8.2 依据上述8.1的规定,即使损失发生于保险合同成立之前,被保险人仍有权要求赔偿保险期间发生的属于本保险承保范围的损失,但被保险人知道损失发生而保险人不知情者除外。
9. 增值条款
9.1 若被保险人对本保险项下的保险标的物安排了增值保险,则该保险标的物的协定价值应视为本保险与其他全部增值保险之保险金额之总和,而本保险项下之责任将按其保险金额占上述全部保险金额之比例确定。索赔时,被保险人必须提供所有其它保险的保险金额的证明。
9.2 本保险为增值保险时,必须适用下列条款:保险标的物的协定价值应视为等于原保险与全部增值保险之保险金额之总和,而本保险项下之责任将按其保险金额占上述总保险金额之比例确定。索赔时,被保险人必须提供所有其它保险的保险金额的证明。
五、保险权益
10. 不得受益条款
承运人或其他受托人不得享有本保险项下之权益
11. 被保险人义务条款
被保险人及其受雇人及代理人对本保险项下可获得索赔的损失,应履行下列义务:
11.1 当损失发生时或发生后,应采取适当措施以合理地避免或减轻损失,及
11.2 应当保留及行使一切对抗承运人、受托人或其它第三人的权利。
保险人同意除本保险可得之任何损失赔偿外,对于被保险人为履行上述义务所作适当、合理支出之一切费用另予补偿。
12. 放弃条款
被保险人或保险人为救助、保护或恢复保险标的物采取之各项措施,不得视为放弃或接受委付或者以任何其它方式损害任何一方当事人的权益。
七、避免延迟
13. 合理处置条款
被保险人在其所能控制的一切情形下,应做合理迅速之安排,为本保险之必要条件。

本保险适用英国法及惯例。
协会战争条款(空运货物)
承保危险

2.6 直接因迟延所导致的灭失、损害或费用,即使此项迟延是因承保危险所导致
2.7 因船舶所有人、经理人、租船人或营运人的丧失偿债能力或逾期偿债所引起的灭失、损害或费用。
2.8 因航程或航行受阻所引起的索赔。
2.9 因使用原子核裂变和/或聚变或其它类似反应或放射性力量或物质所制造的武器所致使的保险标的物的灭失、损害或费用。
保险期间
3.1 本保险自保险标的物或其任何部分被装载上飞机开始运输时起生效。
3.1.1 除以下第3.2和3.3款另有约定外,终止于保险标的物及任何部分在最终目的地自飞机上卸下;或由飞机抵达最终目的地当天午夜起届满15天。以上以先发生者为准。如果经被保险人立即通知保险人并加付额外保险费,则
3.1.2 如保险标的物未于最终目的地卸货,本保险自飞机从该地起飞时恢复有效,且
3.1.3 除以下第3.2和3.3条另有约定外,终止于保险标的物或其任何部分在最终(或替代)目的地自飞机卸下时,或飞机抵达最终目的地或替代目的地当天午夜起届满15天时。 以上述先发生者为准。
3.2 在被保险运输过程中,保险标的物在中转地由飞机卸下,再由另一海轮或飞机转运,依据以下3.3条并于必要时加收保费,本保险自飞机到达该中转地当日午夜开始起算届满15天后终止,但自保险标的物或任何部分载上转运海轮或飞机时重新恢复效力。在此15天期限内,本保险仅对被卸下的保险标的物或其任何部分在该中转地期间继续有效。若保险标的物在此15天期限内被继续运送或本保险根据第3.2条恢复生效时:
3.2.1 如转运由海轮进行,则本保险应视为包含协会货物战争条款,该条款应适用于海运转运阶段。
3.3 若空中如运输终止于运输合同列明目的地以外的地方,则该地方将被视为最终卸货地,本保险即根据第3.1.2条的规定终止。若保险标的物随后需再交付到原目的地或其他目的地,而被保险人于此转运开始前即通知保险人并加付额外保险费,则本保险效力将于下列情况下重新恢复:
3.3.1 如保险标的物已经卸下,当保险标的物或其任何部分被装载上转运飞机驶往原
3.3.2 如保险标的物未被卸下,当飞机由该被视为最终卸货港的地方起航时;其后本保险效力即依据第3.1.4条的规定终止。 3.4若被保险人立即通知保险人并于必要时支付额外保费,本保险在任何绕航或航空承运人依据运输合同授予自由裁量权而作的航程变更期间继续有效。在本第3条中,“海轮”指运载保险标的物从一港口或地方经过海上航程而航行到另一个港口或地方的船舶。
4. 本保险生效后,如被保险人变更目的地,应立即通知保险人,本保险按另行确定的保险费和承保条件暂予承保。
5. 在本合同中任何与第2.8款、第2.9款或第3款不一致者,均属无效。
理赔
6.1 被保险人在损害发生时,必须对保险标的物具有保险利益,始能要求保险赔偿。
6.2 依上述6.1的约定,即使损失发生于保险契约签订之前,被保险人仍有权利要求赔偿保险期间内所发生的属于本保险承保范围的损失,但被保险人知道损害已经发生而保险人不知情者除外。
7.1 若被保险人对本保险项下的保险标的物安排了增值保险,则该保险标的物的协定价值应视为本保险与其他全部增值保险之保险金额之总和,而本保险项下之责任则按其保险金额占上述总保险金额之比例确定。索赔时被保险人须向保险人提供所有其它保险的保险金额的证明。
7.2 本保险为增值保险时,必须适用下列条款:
保险标的物的协定价值应视为等于原保险与全部增值保险之保险金额之总和,而本保险项下之责任则按其保险金额占上述总保险金额的比例确定。索赔时被保险人须向保险提供所有其它保险的保险金额的证明。
保险权益
8. 承运人或其他受托人不得享有本保险项下之权益。
减轻损失
9. 被保险人及其受雇人及代理人对本保险项下可获得索赔的损失,应履行下列义务:
9.1 当损失发生时或发生后,应采取适当措施避免或减轻上述损失。及

12. 本保险适用英国法律及惯例。
协会重置-条款
如果由本保险承保的风险造成被保险机器的部件发生损失或损害,赔付金额不应超过对此部件更换或修理的费用加运费和重装的费用,但不包括关税,除非全部关税包含在保险金额中,在此种情况下,由于支付附加关税而遭受的损失亦可获得赔偿。
保险人的赔偿责任在任何情况下不应超过整件机器的保险价值。
公路货物运输保险附加盗窃、抢劫保险条款(2009版)
第一条 保险责任
保险人对保险货物在保险期间内由于外来的有明显盗窃、抢劫、哄抢痕迹并经公安部门证明确系盗窃、抢劫、哄抢行为以及全车被他人诈骗所致的直接经济损失承担赔偿责任。
第二条 责任起迄
在保险合同有效期内,每次运输的保险责任起讫期为保险货物自运离保险凭证(保险单)上载明的起运地时起,至运抵保险凭证(保险单)载明的目的地卸离运输工具时止。但保险货物运抵目的地后,如果收货人未及时卸货,则保险责任的终止期从抵达目的地当日零时起计算最多延长48小时。
第三条 责任免除
下列原因造成保险货物的损失,保险人不负赔偿责任:
1. 保险货物被政府有关部门征用、罚没、扣押;
2. 被保险人或驾驶员与他人发生民事纠纷;
3. 投保人或被保险人的故意行为、违法犯罪行为;
4. 其他不属于保险责任范围的原因。
第四条 投保人或被保险人的义务
1. 投保人或被保险人获知或应当获知保险货物发生保险责任范围内的损失后,应立即向当地公安部门报案,并同时通知保险人。故意或者因重大过失未及时通知,致使保险事故的性质、原因、损失程度等难以确定的,保险人对无法确定的部分,不承担赔偿责任,但保险人通过其他途径已经及时知道或者应当及时知道保险事故发生的除外。
2. 当货物发生损失时,投保人或被保险人应采取积极有效措施制止货物损失进一步扩大,否则保险人就损失扩大部分不负赔偿责任。
第五条 赔偿处理
1. 被保险人向保险人索赔时,须提供出险地公安部门出具的证明;全车被骗的,须提供出险地县级以上(含县级)公安刑侦部门出具的证明。否则,保险人有权对部分或全部经济损失不负赔偿责任。
2. 本附加险责任范围内的盗窃、抢劫、哄抢所造成的保险货物的直接经济损失,在被保险人报案30天后未能侦破,并由被保险人出具盗窃、抢劫、哄抢事故报告、损失清单、公安部门的证明材料及被保险人所能提供的其他与确认保险事故的性质、原因、损失程度等有关的证明和资料后,保险人给予赔偿。全车被骗所致保险货物的直接经济损失,须经县级以上(含县级)公安刑侦部门立案满三个月未能侦破,被保险人出具公安部门的证明材料及保险人认为必要的其他单证后保险人给予赔偿。
3. 经公安部门破案被追回的保险货物,双方应当协商处理。
4. 保险货物发生保险责任范围内的损失时,赔偿按主险条款赔偿处理的有关规定计算赔偿金额。被盗、被抢货物的赔偿均实行20%的绝对免赔,全车被骗的赔偿实行30%的绝对免赔。
第六条 其他事项
本条款为《公路货物运输保险条款(2009版)》、《国内货物运输公路定额保险条款(2009版)》的附加条款。本条款与上述条款相抵触之处,以本条款为准,其他未尽事项以主险条款为准。
公路货物运输保险条款(2009版)
保险标的范围
第一条
凡在国内经公路运输的货物均可为本保险之标的。
第二条
下列货物非经投保人与保险人特别约定,并在保险单(凭证)上载明,不在保险标的范围以内:金银、珠宝、钻石、玉器、首饰、古币、古玩、古书、古画、邮票、艺术品、稀有金属等珍贵财物。
第三条
下列货物不在保险标的范围以内:蔬菜、水果、活牲畜、禽鱼类和其它动物。
保险责任
第四条
由于下列保险事故造成保险货物的损失和费用,保险人依照本条款约定负责赔偿:
(一)火灾、爆炸、雷电、冰雹、暴风、暴雨、洪水、海啸、地陷、崖崩、突发性滑坡、泥石流;
(二)由于运输工具发生碰撞、倾覆或隧道、码头坍塌,或在驳运过程中因驳运工具遭受搁浅、触礁、沉没、碰撞;
(三)在装货、卸货或转载时因意外事故造成的损失;
(四)因碰撞、挤压而造成货物破碎、弯曲、凹瘪、折断、开裂的损失;
(五)因包装破裂致使货物散失的损失;
(六)液体货物因受碰撞或挤压致使所用容器(包括封口)损坏而渗漏的损失,或用液体保藏的货物因液体渗漏而造成该货物腐烂变质的损失;
(七)符合安全运输规定而遭受雨淋所致的损失;
(八)在发生上述灾害事故时,因纷乱造成货物的散失以及因施救或保护货物所支付的直接合理的费用。
责任免除
第五条
由于下列原因造成保险货物的损失,保险人不负赔偿责任:
(一)战争、敌对行为、军事行动、扣押、罢工、暴动、哄抢;
(二)地震造成的损失;
(三)盗窃或整件提货不着的损失;
(四)在保险责任开始前,保险货物已存在的品质不良或数量短差所造成的损失;
(五)保险货物的自然损耗,本质缺陷、特性所引起的损失或费用;
(六)市价跌落、运输延迟所引起的损失;
(七)属于发货人责任引起的损失;
(八)投保人、被保险人的故意行为或违法犯罪行为。
第六条
经国家有关部门认定的违法、非法货物,保险人不负赔偿责任。
第七条
其他不属于保险责任范围的损失,保险人不负赔偿责任。
责任起讫
第八条
保险责任自签发保险凭证后,保险货物运离起运地发货人的最后一个仓库或储存处所时起,至该保险凭证上注明的目的地的收货人在当地的第一个仓库或储存处所时终止。但保险货物运抵目的地后,如果收货人未及时提货,则保险责任的终止期最多延长至保险货物卸离运输工具后的十五天为限。
保险价值和保险金额
第九条
保险价值为货物的实际价值,按货物的实际价值或货物的实际价值加运杂费确定。保险金额由投保人参照保险价值自行确定,并在保险合同中载明。保险金额不得超过保险价值。超过保险价值的,超过部分无效,保险人应当退还相应的保险费。
投保人、被保险人的义务
第十条
投保人应当履行如实告知义务,如实回答保险人就保险标的或者被保险人的有关情况提出的询问。
投保人故意或因重大过失未履行前款规定的如实告知义务,足以影响保险人决定是否同意承保或者提高保险费率的,保险人有权解除保险合同。
投保人故意不履行如实告知义务的,保险人对于保险合同解除前发生的保险事故,不承担赔偿责任,并不退还保险费。
投保人因重大过失未履行如实告知义务,对保险事故的发生有严重影响的,保险人对于保险合同解除前发生的保险事故,不承担赔偿责任,但应当退还保险费。
第十一条
投保人在保险人或其代理人签发保险单(凭证)的同时,应一次交清应付的保险费。若投保人未按照约定交付保险费,保险费交付前发生的保险事故,保险人不承担赔偿责任。
第十二条
投保人和被保险人应当严格遵守国家及交通运输部门关于安全运输的各项规定,维护保险标的的安全。货物运输包装必须符合国家和主管部门规定的标准。
保险人可以对保险标的的安全状况进行检查,向投保人、被保险人提出消除不安全因素和隐患的书面建议,被保险人应该认真付诸实施。
对于因被保险人未遵守上述约定而导致保险事故的,保险人不负赔偿责任;对于因被保险人未遵守上述约定而导致损失扩大的,保险人对扩大的损失不负赔偿责任。
第十三条
在合同有效期内,保险标的危险程度显著增加的,被保险人按照合同约定应当及时通知保险人,保险人有权要求增加保险费或者解除合同。
被保险人未履行前款规定的通知义务的,因保险标的危险程度显著增加而发生的保险事故,保险人不承担赔偿责任。
第十四条 保险货物如果发生保险责任范围内的损失时,投保人或被保险人获悉后,应迅速采取合理的施救和保护措施并立即通知保险人的当地机构(最迟不超过10天)。
故意或者因重大过失未及时通知,致使保险事故的性质、原因、损失程度等难以确定的,保险人对无法确定的部分,不承担赔偿责任,但保险人通过其他途径已经及时知道或者应当及时知道保险事故发生的除外。
赔偿处理
第十五条
被保险人向保险人申请索赔时,必须提供下列有关单证:
(一)保险单(凭证)、运单(货票)、提货单、发票(货价证明);
(二)承运部门签发的事故签证、交接验收记录、鉴定书;
(三)收货单位的入库记录、检验报告、损失清单及救护保险货物所支付的直接合理的费用单据;
(四)被保险人所能提供的其他与确认保险事故的性质、原因、损失程度等有关的证明和资料。
保险人收到被保险人的赔偿请求后,应当及时就是否属于保险责任作出核定,并将核定结果通知被保险人。情形复杂的,保险人在收到被保险人的赔偿请求并提供理赔所需资料后三十日内未能核定保险责任的,保险人与被保险人根据实际情形商议合理期间,保险人在所商定的期间内作出核定结果并通知被保险人。对属于保险责任的,在与被保险人达成有关赔偿金额的协议后十日内,履行赔偿义务。
第十六条
保险货物发生保险责任范围内的损失时,保险金额等于或高于保险价值时,保险人应根据实际损失计算赔偿,但最高赔偿金额以保险价值为限;保险金额低于保险价值的,保险人对其损失金额及支付的施救保护费用按保险金额与保险价值的比例计算赔偿。保险人对货物损失的赔偿金额,以及因施救或保护货物所支付的直接合理的费用,应分别计算,并各以不超过保险金额为限。
第十七条
保险货物发生保险责任范围内的损失,如果根据法律规定或有关约定,应当由承运人或其他第三者负责赔偿部分或全部的,被保险人应首先向承运人或其他第三者提出书面索赔,直至诉讼。保险事故发生后,保险人未赔偿保险金之前,被保险人放弃对有关责任方请求赔偿的权利的,保险人不承担赔偿责任;如被保险人要求保险人先予赔偿,被保险人应签发权益转让书和应将向承运人或第三者提出索赔的诉讼书及有关材料移交给保险人,并协助保险人向责任方追偿。
由于被保险人的故意或重大过失致使保险人不能行使代位请求赔偿权利的,保险人可以相应扣减保险赔偿金。
第十八条
经双方协商同意,保险人可将其享有的保险财产残余部分的权益作价折归被保险人,并可在保险赔偿金中直接扣除。
第十九条
被保险人与保险人发生争议时,协商解决,双方不能达成协议时,可以提交仲裁机关或法院处理。
本保险合同适用中华人民共和国法律(不包括港澳台地区法律)。
其他事项
第二十条
凡经公路与其他运输方式联合运输的保险货物,按相应的运输方式分别适用本条款及《铁路货物运输保险条款(2009版)》、《水路货物运输保险条款(2009版)》和《国内航空货物运输保险条款(2009版)》。
第二十一条
凡涉及本保险的约定均采用书面形式。
国内航空货物运输保险条款(2009版)
保险标的范围
第一条
凡在国内经航空运输的货物均可为本保险之标的。

(二)因飞机遭受碰撞、倾覆、坠落、失踪(在三个月以上),在危难中发生卸载以及遭受恶劣气候或其它危难事故发生抛弃行为所造成的损失;
(三)因受震动、碰撞或压力而造成破碎、弯曲、凹瘪、折断、开裂的损失;
(四)因包装破裂致使货物散失的损失;
(五)凡属液体、半流体或者需要用液体保藏的保险货物,在运输途中因受震动、碰撞或压力致使所装容器(包括封口)损坏发生渗漏而造成的损失,或用液体保藏的货物因液体渗漏而致保藏货物腐烂的损失;
(六)遭受盗窃或者提货不着的损失;
(七)在装货、卸货时和港内地面运输过程中,因遭受不可抗力的意外事故及雨淋所造成的损失。
第五条
在发生责任范围内的灾害事故时,因施救或保护保险货物而支付的直接合理费用。
责任免除
第六条
由于下列原因造成保险货物的损失,保险人不负责赔偿:
(一)战争、军事行动、扣押、罢工、哄抢和暴动;
(二)核反应、核子幅射和放射性污染;
(三)保险货物自然损耗,本质缺陷、特性所引起的污染、变质、损坏,以及货物包装不善;
(四)在保险责任开始前,保险货物已存在的品质不良或数量短差所造成的损失;
(五)市价跌落、运输延迟所引起的损失;
(六)属于发货人责任引起的损失;
(七)被保险人或投保人的故意行为或违法犯罪行为。
第七条
由于行政行为或执法行为所致的损失,保险人不负责赔偿。
第八条
其他不属于保险责任范围内的损失,保险人不负责赔偿。
责任起迄
第九条
保险责任自保险货物经承运人收讫并签发保险单(凭证)时起,至该保险单(凭证)上的目的地的收货人在当地的第一个仓库或储存处所时终止。但保险货物运抵目的地后,如果收货人未及时提货,则保险责任的终止期最多延长至以收货人接到《到货通知单》以后的十五天为限(以邮戳日期为准)。
第十条
由于被保险人无法控制的运输延迟、绕道、被迫卸货、重新装载、转载或承运人运用运输契约赋予的权限所作的任何航行上的变更或终止运输契约,致使保险货物运输到非保险单所载目的地时,在被保险人及时将获知的情况通知保险人,并在必要时加交保险费的情况下,本保险仍继续有效。保险责任按下述规定终止:
(一)保险货物如在非保险单所载目的地出售,保险责任至交货时为止。但不论任何情况,均以保险货物在卸载地卸离飞机后满十五天为止。
(二)保险货物在上述十五天期限内继续运往保险单所载原目的地或其他目的地时,保险责任仍按上述第(一)款的规定终止。
保险价值和保险金额
第十一条

国内水路、陆路货物运输保险条款(2009版)
总则
第一条
为使保险货物在水路、铁路、公路和联运运输中,因遭受保险责任范围内的自然灾害或意外事故所造成的损失能够得到经济补偿,并加强货物的安全防损工作,以利商品生产和商品流通,特举办保险。
保险责任
第二条
本保险分为基本险和综合险两种。保险货物遭受损失时,保险人按承保险别的责任范围负赔偿责任。
(一)基本险:
1. 因火灾、爆炸、雷电、冰雹、暴风、暴雨、洪水、地震、海啸、地陷、崖崩、滑坡、泥石流所造成的损失;
2. 由于运输工具发生碰撞、搁浅、触礁、倾覆、沉没、出轨或隧道、码头坍塌所造成的损失;
3. 在装货、卸货或转载时因遭受不属于包装质量不善或装卸人员违反操作规程所造成的损失;
4. 按国家规定或一般惯例应分摊的共同海损的费用;
5. 在发生上述灾害、事故时,因纷乱而造成货物的散失及因施救或保护货物所支付的直接合理的费用。
(二)综合险:本保险除包括基本险责任外,保险人还负责赔偿:
1. 因受震动、碰撞、挤压而造成货物破碎、弯曲、凹瘪、折断、开裂或包装破裂致使货物散失的损失;
2. 液体货物因受震动、碰撞或挤压致使所用容器(包括封口)损坏而渗漏的损失,或用液体保藏的货物因液体渗漏而造成保藏货物腐烂变质的损失;
3. 遭受盗窃或整件提货不着的损失;
4. 符合安全运输规定而遭受雨淋所致的损失。
除外责任
第三条
由于下列原因造成保险货物的损失,保险人不负赔偿责任:
1. 战争或军事行动;
2. 核事件或核爆炸;
3. 保险货物本身的缺陷或自然损耗,以及由于包装不善;
4. 被保险人的故意行为或过失;
5. 全程是公路货物运输的,盗窃和整件提货不着的损失;
6. 其他不属于保险责任范围内的损失。

如果被保险人投保不足,保险金额低于货价时,保险人对其损失金额及支付的施救保护费用按保险金额与货价的比例计算赔偿。保险人对货物损失的赔偿金额,以及因施救或保护货物所支付的直接、合理的费用,应分别计算,并各以不超过保险金额为限。

海洋运输货物保险条款(2009版)

一、责任范围
本保险分为平安险、水渍险及一切险三种。被保险货物遭受损失时,本保险按照保险单上订明承保险别的条款规定,负赔偿责任。
(一)平安险
本保险负责赔偿:
1. 被保险货物在运输途中由于恶劣气候、雷电、海啸、地震、洪水自然灾害造成整批货物的全部损失或推定全损。当被保险人要求赔付推定全损时,须将受损货物及其权利委付给保险人。被保险货物用驳船运往或运离海轮的,每一驳船所装的货物可视作一个整批。推定全损是指被保险货物的实际全损已经不可避免,或者恢复、修复受损货物以及运送货物到原订目的地的费用超过该目的地的货物价值。
2. 由于运输工具遭受搁浅、触礁、沉没、互撞、与流冰或其他物体碰撞以及失火、爆炸意外事故造成货物的全部或部分损失。
3. 在运输工具已经发生搁浅、触礁、沉没、焚毁意外事故的情况下,货物在此前后又在海上遭受恶劣气候、雷电、海啸等自然灾害所造成的部分损失。
4. 在装卸或转运时由于一件或数件整件货物落海造成的全部或部分损失。
5. 被保险人对遭受承保责任内危险的货物采取抢救、防止或减少货损的措施而支付的合理费用,但以不超过该批被救货物的保险金额为限。
6. 运输工具遭遇海难后,在避难港由于卸货所引起的损失以及在中途港、避难港由于卸货、存仓以及运送货物所产生的特别费用。
7. 共同海损的牺牲、分摊和救助费用。
8. 运输契约订有“船舶互撞责任”条款,根据该条款规定应由货方偿还船方的损失。
(二)水渍险
除包括上列平安险的各项责任外,本保险还负责被保险货物由于恶劣气候、雷电、海啸、地震、洪水自然灾害所造成的部分损失。
(三)一切险
除包括上列平安险和水渍险的各项责任外,本保险还负责被保险货物在运输途中由于外来原因所致的全部或部分损失。
二、除外责任
本保险对下列损失不负赔偿责任:
(一)被保险人的故意行为或过失所造成的损失。
(二)属于发货人责任所引起的损失。
(三)在保险责任开始前,被保险货物已存在的品质不良或数量短差所造成的损失。
(四)被保险货物的自然损耗、本质缺陷、特性以及市价跌落、运输延迟所引起的损失或费用。
(五)本公司海洋运输货物战争险条款和货物运输罢工险条款规定的责任范围和除外责任。
三、责任起讫
(一)本保险负“仓至仓”责任,自被保险货物运离保险单所载明的起运地仓库或储存处所开始运输时生效,包括正常运输过程中的海上、陆上、内河和驳船运输在内,直至该项货物到达保险单所载明目的地收货人的最后仓库或储存处所或被保险人用作分配、分派或非正常运输的其他储存处所为止。如未抵达上述仓库或储存处所,则以被保险货物在最后卸载港全部卸离海轮后满六十天为止。如在上述六十天内被保险货物需转运到非保险单所载明的目的地时,则以该项货物开始转运时终止。
(二)由于被保险人无法控制的运输延迟、绕道、被迫卸货、重新装载、转载或承运人运用运输契约赋予的权限所作的任何航海上的变更或终止运输契约,致使被保险货物运到非保险单所载明目的地时,在被保险人及时将获知的情况通知保险人,并在必要时加交保险费的情况下,本保险仍继续有效,保险责任按下列规定终止。
1. 被保险货物如在非保险单所载明的目的地出售,保险责任至交货时为止,但不论任何情况,均以被保险货物在卸载港全部卸离海轮后满六十天为止。
2. 被保险货物如在上述六十天期限内继续运往保险单所载原目的地或其他目的地时,保险责任仍按上述第(一)款的规定终止。
四、被保险人义务
被保险人应按照以下规定的应尽义务办理有关事项。
(一)当被保险货物运抵保险单所载明的目的港(地)以后,被保险人应及时提货,当发现被保险货物遭受任何损失,应即向保险单上所载明的检验、理赔代理人申请检验,如发现被保险货物整件短少或有明显残损痕迹应即向承运人、受托人或有关当局(海关、港务当局等)索取货损货差证明。如果货损货差是由于承运人、受托人或其他有关方面的责任所造成,并应以书面方式向他们提出索赔,必要时还须取得延长时效的认证。如未履行上述规定义务,保险人对有关损失不负赔偿责任。
(二)对遭受承保责任内危险的货物,被保险人和保险人都可迅速采取合理的抢救措施,防止或减少货物的损失,被保险人采取此项措施,不应视为放弃委付的表示,保险人采取此项措施,也不得视为接受委付的表示。
对由于被保险人未履行上述义务造成的扩大的损失,保险人不负赔偿责任。
(三)如遇航程变更或发现保险单所载明的货物、船名或航程有遗漏或错误时,被保险人应在获悉后立即通知保险人并在必要时加交保险费,本保险才继续有效。
(四)在向保险人索赔时,必须提供下列单证:保险单正本、提单、发票、装箱单、磅码单、货损货差证明、检验报告及索赔清单。如涉及第三者责任,还须提供向责任方追偿的有关函电及其他必要单证或文件。
被保险人未履行前款约定的单证提供义务,导致保险人无法核实损失情况的,保险人对无法核实的部分不承担赔偿责任。
(五)在获悉有关运输契约中“船舶互撞责任”条款的实际责任后,应及时通知保险人。否则,保险人对有关损失不负赔偿责任。
五、赔偿处理
保险人收到被保险人的赔偿请求后,应当及时就是否属于保险责任作出核定,并将核定结果通知被保险人。情形复杂的,保险人在收到被保险人的赔偿请求并提供理赔所需资料后三十日内未能核定保险责任的,保险人与被保险人根据实际情形商议合理期间,保险人在商定的期间内作出核定结果并通知被保险人。对属于保险责任的,在与被保险人达成有关赔偿金额的协议后十日内,履行赔偿义务。
六、索赔期限
本保险索赔时效,从保险事故发生之日起起算,最多不超过二年。
海洋运输货物战争险条款(2009版)
一、责任范围
本保险负责赔偿:
(一)直接由于战争、类似战争行为和敌对行为、武装冲突或海盗行为所致的损失。
(二)由于上述第(一)款引起的捕获、拘留、扣留、禁制、扣押所造成的损失。
(三)各种常规武器,包括水雷、鱼雷、炸弹所致的损失。
(四)本条款责任范围引起的共同海损的牺牲、分摊和救助费用。
二、除外责任
本保险对下列各项,不负赔偿责任:
(一)由于敌对行为使用原子或热核制造的武器所致的损失和费用。
(二)根据执政者、当权者、或其他武装集团的扣押、拘留引起的承保航程的丧失和挫折而提出的任何索赔。
三、责任起讫
(一)本保险责任自被保险货物装上保险单所载起运港的海轮或驳船时开始,到卸离保险单所载明的目的港的海轮或驳船时为止。如果被保险货物不卸离海轮或驳船,本保险责任最长期限以海轮到达目的港的当日午夜起算满十五天为限,海轮到达上述目的港是指海轮在该港区内一个泊位或地点抛锚、停泊或系缆,如果没有这种泊位或地点,则指海轮在原卸货港或地点或附近第一次抛锚、停泊或系缆。
(二)如在中途港转船,不论货物在当地卸载与否,保险责任以海轮到达该港或卸货地点的当日午夜起算满十五天为止,俟再装上续运海轮时恢复有效。
(三)如运输契约在保险单所载明目的地以外的地点终止时,该地即视为本保险目的地,仍照前述第(一)款的规定终止责任,如需运往原目的地或其他目的地时,在被保险人于续运前通知保险人并加交保险费的情况下,可自装上续运的海轮时重新有效。
(四)如运输发生绕道,改变航程或承运人运用运输契约赋予的权限所作的任何航海上的改变,在被保险人及时将获知情况通知保险人,在必要时加交保险费的情况下,本保险仍继续有效。

航空运输货物保险条款(2009版)
一、责任范围
本保险分为航空运输险和航空运输一切险二种。被保险货物遭受损失时,本保险按保险单上订明承保险别的条款负赔偿责任。
(一)航空运输险
本保险负责赔偿:
1、被保险货物在运输途中遭受雷电、火灾或爆炸或由于飞机遭受恶劣气候或其它危难事故而被抛弃,或由于飞机遭受碰撞、倾覆、坠落或失踪意外事故所造成的全部或部分损失。
2、被保险人对遭受承保责任内危险的货物采取抢救,防止或减少货损的措施而支付的合理费用,但以不超过该批被救货物的保险金额为限。
(二)航空运输一切险
除包括上列航空运输险的责任外,本保险还负责被保险货物由于外来原因所致的全部或部分损失。
二、除外责任
本保险对下列损失,不负赔偿责任:
(一)被保险人的故意行为或过失所造成的损失。
(二)属于发货人责任所引起的损失。
(三)保险责任开始前,被保险货物已存在的品质不良或数量短差所造成的损失。
(四)被保险货物的自然损耗、本质缺陷、特性以及市价跌落、运输延迟所引起的损失或费用。
(五)本公司航空运输货物战争险条款和货物运输罢工险条款规定的责任范围和除外责任。
三、责任起迄
(一)本保险负“仓至仓”责任,自被保险货物运离保险单所载明的起运地仓库或储存处所开始运输时生效,包括正常运输过程中的运输工具有内,直到该项货物运达保险单所载明目的地收货人的最后仓库或储存处所或被保险人用作分配、分派或非正常运输的其它储存处所为止。如未运抵上述仓库或储存处所,则以被保险货物在最后卸载地卸离飞机后满三十天为止。如在上述三十天内被保险的货物需转送到非保险单所载明的目的地时,则以该项货物开始转运时终止。
(二)由于被保险人无法控制的运输延迟、绕道、被迫卸货、重新装载、转载或承运人运用运输契约赋予的权限所作的任何航行上的变更或终止运输契约。致使被保险货物运到非保险单所载目的地时,在被保险人及时将获知的情况通知保险人,并在必要时加交保险费的情况下,本保险仍继续有效,保险责任按下述规定终止:
1、被保险货物如在非保险单所载目的地出售,保险责任至交货时为止,但不论任何情况,均以被保险的货物在卸载地卸离飞机后满三十天为止。

货物运输罢工险条款(2009版)
一、责任范围
在保险单注明承保罢工险时,本保险对被保险货物由于罢工者,被迫停工工人或参加工潮、暴动、民众斗争的人员的行动,或任何人的恶意行为所造成的直接损失和上述行动或行为所引起的共同海损的牺牲、分摊和救助费用负赔偿责任。
二、除外责任
本保险对下列各项,不负赔偿责任:
在罢工期间由于劳动力短缺或不能履行正常职责所致的保险货物的损失,包括因此而引起的动力或燃料缺乏使冷藏机停止工作所致的冷藏货物的损失。

陆上运输货物保险条款(火车、汽车)(2009版)
一、责任范围
本保险分为陆运险和陆运一切险二种。被保险货物遭受损失时,本保险按保险单上订明承保险别的条款规定,负赔偿责任。
(一)陆运险
本保险负责赔偿:
1、被保险货物在运输途中遭受暴风、雷电、洪水、地震自然灾害,或由于运输工具遭受碰撞、倾覆、出轨,或在驳运过程中因驳运工具遭受搁浅、触礁、沉没、碰撞,或由于遭受隧道坍塌,崖崩,或失火、爆炸意外事故所造成的全部或部分损失。
2、被保险人对遭受承保责任内危险的货物采取抢救,防止或减少货损的措施而支付的合理费用,但以不超过该批被救货物的保险金额为限。
(二)陆运一切险
除包括上列陆运险的责任外,本保险还负责被保险货物在运输途中由于外来原因所致的全部或部分损失。

本保险对下列损失,不负赔偿责任:

四、被保险人的义务
被保险人应按照以下规定的应尽义务办理有关事项。

(三)如运送契约在保险单所载目的地以外的地点终止时,该地即视为本保险目的地,仍照前述第(一)款的规定终止责任。

水路货物运输保险条款(2009版)
保险标的范围
第一条
凡在国内江、河、湖泊和沿海经水路运输的货物均可为本保险之标的。
第二条
下列货物非经投保人与保险人特别约定,并在保险单(凭证)上载明,不在保险标的范围以内:金银、珠宝、钻石、玉器、首饰、古币、古玩、古书、古画、邮票、艺术品、稀有金属等珍贵财物。
第三条
下列货物不在保险标的范围以内:蔬菜、水果、活牲畜、禽鱼类和其它动物。
第四条
本保险分为基本险和综合险,保险人按保险单注明的承保险别分别承担保险责任。
保险责任
第五条
本保险分为基本险和综合险,保险人按保险单注明的承保险别分别承担保险责任。
第六条 基本险
由于下列保险事故造成保险货物的损失和费用,保险人依照本条款约定负责赔偿:
(一)因火灾、爆炸、雷电、冰雹、暴风、暴雨、洪水、海啸、崖崩、突发性滑坡、泥石流;
(二)船舶发生碰撞、搁浅、触礁,桥梁码头坍塌;
(三)因以上两款所致船舶沉没失踪;
(四)在装货、卸货或转载时因意外事故造成的损失;
(五)按国家规定或一般惯例应承担的共同海损的牺牲、分摊和救助费用;
(六)在发生上述灾害事故时,因纷乱造成货物的散失以及因施救或保护货物所支付的直接合理的费用。
第七条 综合险
本保险除包括基本险责任外,保险人还负责赔偿:
(一)因受碰撞、挤压而造成货物破碎、弯曲、凹瘪、折断、开裂的损失;
(二)因包装破裂致使货物散失的损失;
(三)液体货物因受碰撞或挤压致使所用容器(包括封口)损坏而渗漏的损失,或用液体保藏的货物因液体渗漏而造成该货物腐烂变质的损失;
(四)遭受盗窃的损失;
(五)符合安全运输规定而遭受雨淋所致的损失。
责任免除
第八条
由于下列原因造成保险货物的损失,保险人不负赔偿责任:
(一)战争、军事行动、扣押、罢工、哄抢和暴动;
(二)船舶本身的损失;
(三)在保险责任开始前,保险货物已存在的品质不良或数量短差所造成的损失;
(四)保险货物的自然损耗,本质缺陷、特性所引起的污染、变质、损坏;
(五)市价跌落、运输延迟所引起的损失;
(六)属于发货人责任引起的损失;
(七)投保人、被保险人的故意行为或违法犯罪行为。
第九条
由于行政行为或执法行为所致的损失,保险人不负赔偿责任。
第十条
其他不属于保险责任范围内的损失,保险人不负赔偿责任。
责任起迄
第十一条
保险责任自签发保险单(凭证)后,保险货物运离起运地发货人的最后一个仓库或储存处所时起,至该保险凭证上注明的目的地的收货人在当地的第一个仓库或储存处所时终止。但保险货物运抵目的地后,如果收货人未及时提货,则保险责任的终止期最多延长至保险货物卸离运输工具后的十五天为限。
保险价值和保险金额
第十二条
保险价值为货物的实际价值,按货物的实际价值或货物的实际价值加运杂费确定。保险金额由投保人参照保险价值自行确定,并在保险合同中载明。保险金额不得超过保险价值。超过保险价值的,超过部分无效,保险人应当退还相应的保险费。
投保人、被保险人的义务
第十三条
投保人应当履行如实告知义务,如实回答保险人就保险标的或者被保险人的有关情况提出的询问。
投保人故意或者因重大过失未履行前款规定的如实告知义务,足以影响保险人决定是否同意承保或者提高保险费率的,保险人有权解除合同。保险合同自保险人的解约通知书到达投保人或被保险人时解除。
投保人故意不履行如实告知义务的,保险人对于保险合同解除前发生的保险事故,不承担赔偿责任,并不退还保险费。
投保人因重大过失未履行如实告知义务,对保险事故的发生有严重影响的,保险人对于保险合同解除前发生的保险事故,不承担赔偿或者给付保险金的责任,但应当退还保险费。
第十四条
投保人在保险人或其代理人签发保险单(凭证)的同时,应一次交清应付的保险费。若投保人未按照约定交付保险费,保险费交付前发生的保险事故,保险人不承担赔偿责任。
第十五条
投保人、被保险人应当谨慎选择承运人,并督促其严格遵守国家及交通运输部门关于安全运输的各项规定,还应当接受并协助保险人对保险货物进行的查验防损工作,货物运输包装必须符合国家和主管部门规定的标准。
对于因被保险人未遵守上述约定而导致保险事故的,保险人不负赔偿责任;对于因被保险人未遵守上述约定而导致损失扩大的,保险人对扩大的损失不负赔偿责任。
第十六条
在合同有效期内,保险标的危险程度显著增加的,被保险人按照合同约定应当及时通知保险人,保险人有权要求增加保险费或者解除合同。
被保险人未履行前款规定的通知义务的,因保险标的危险程度显著增加而发生的保险事故,保险人不承担赔偿责任。
第十七条
被保险人获悉或应当获悉保险货物发生保险责任范围内的损失时,应立即通知保险人或保险人在当地保险机构,并迅速采取合理的施救和保护措施,减少货物损失。
故意或者因重大过失未及时通知,致使保险事故的性质、原因、损失程度等难以确定的,保险人对无法确定的部分,不承担赔偿责任,但保险人通过其他途径已经及时知道或者应当及时知道保险事故发生的除外。
赔偿处理
第十八条
保险货物运抵保险凭证所载明的目的地的收货人在当地的第一个仓库或储存处所时起,被保险人应在十天内向保险人的当地保险机构申请并会同检验受损的货物。
第十九条
被保险人向保险人申请索赔时,应当提供下列有关单证:
(一)保险单(凭证)、运单(货票)、提货单、发票(货价证明);
(二)承运部门签发的货运记录、普通记录、交接验收记录、鉴定书;
(三)收货单位的入库记录、检验报告、损失清单及救护货物所支付的直接费用的单据;
(四)被保险人所能提供的其他与确认保险事故的性质、原因、损失程度等有关的证明和资料。保险人收到被保险人的赔偿请求后,应当及时就是否属于保险责任作出核定,并将核定结果通知被保险人。情形复杂的,保险人在收到被保险人的赔偿请求并提供理赔所需资料后三十日内未能核定保险责任的,保险人与被保险人根据实际情形商议合理期间,保险人在商定的期间内作出核定结果并通知被保险人。对属于保险责任的,在与被保险人达成有关赔偿金额的协议后十日内,履行赔偿义务。
第二十条
保险货物发生保险责任范围内的损失时,保险金额等于或高于保险价值时,保险人应根据实际损失计算赔偿,但最高赔偿金额以保险金额价值为限;保险金额低于保险价值的,保险人对其损失金额及支付的施救保护费用按保险金额与保险价值的比例计算赔偿。
保险人对货物损失的赔偿金额,以及因施救或保护货物所支付的直接合理的费用,应分别计算,并各以不超过保险金额为限。
第二十一条
保险货物发生保险责任范围内的损失时,如果根据法律规定或有关约定,应当由承运人或其他第三者负责赔偿部分或全部的,被保险人应首先向承运人或其他第三者提出书面索赔,直至诉讼。保险事故发生后,保险人未履行赔偿义务保险金之前,被保险人放弃对有关责任方请求赔偿的权利的,保险人不承担赔偿责任;如被保险人要求保险人先予赔偿,被保险人应签发权益转让书和应将向承运人或第三者提出索赔的诉讼书及有关材料移交给保险人,并协助保险人向责任方追偿。
由于被保险人的故意或重大过失致使保险人不能行使代位请求赔偿权利的,保险人可以相应扣减保险赔偿金。
第二十二条
经双方协商同意,保险人可将其享有的保险财产残余部分的权益作价折归被保险人,并可在保险赔偿金中直接扣除。
第二十三条
被保险人与保险人发生争议时,应当实事求是,协商解决,双方不能达成协议时,可以提交仲裁机关或法院处理。
本保险合同适用中华人民共和国法律(不包括港澳台地区法律)。
投保人、被保险人的义务
第十三条
投保人应当履行如实告知义务,如实回答保险人就保险标的或者被保险人的有关情况提出的询问。
投保人故意或者因重大过失未履行前款规定的如实告知义务,足以影响保险人决定是否同意承保或者提高保险费率的,保险人有权解除合同。保险合同自保险人的解约通知书到达投保人或被保险人时解除。
投保人故意不履行如实告知义务的,保险人对于保险合同解除前发生的保险事故,不承担赔偿责任,并不退还保险费。
投保人因重大过失未履行如实告知义务,对保险事故的发生有严重影响的,保险人对于保险合同解除前发生的保险事故,不承担赔偿或者给付保险金的责任,但应当退还保险费。
第十四条
投保人在保险人或其代理人签发保险单(凭证)的同时,应一次交清应付的保险费。若投保人未按照约定交付保险费,保险费交付前发生的保险事故,保险人不承担赔偿责任。
第十五条
投保人、被保险人应当谨慎选择承运人,并督促其严格遵守国家及交通运输部门关于安全运输的各项规定,还应当接受并协助保险人对保险货物进行的查验防损工作,货物运输包装必须符合国家和主管部门规定的标准。
对于因被保险人未遵守上述约定而导致保险事故的,保险人不负赔偿责任;对于因被保险人未遵守上述约定而导致损失扩大的,保险人对扩大的损失不负赔偿责任。
第十六条
在合同有效期内,保险标的危险程度显著增加的,被保险人按照合同约定应当及时通知保险人,保险人有权要求增加保险费或者解除合同。
被保险人未履行前款规定的通知义务的,因保险标的危险程度显著增加而发生的保险事故,保险人不承担赔偿责任。
第十七条
被保险人获悉或应当获悉保险货物发生保险责任范围内的损失时,应立即通知保险人或保险人在当地保险机构,并迅速采取合理的施救和保护措施,减少货物损失。
故意或者因重大过失未及时通知,致使保险事故的性质、原因、损失程度等难以确定的,保险人对无法确定的部分,不承担赔偿责任,但保险人通过其他途径已经及时知道或者应当及时知道保险事故发生的除外。
赔偿处理
第十八条
保险货物运抵保险凭证所载明的目的地的收货人在当地的第一个仓库或储存处所时起,被保险人应在十天内向保险人的当地保险机构申请并会同检验受损的货物。
第十九条
被保险人向保险人申请索赔时,应当提供下列有关单证:
(一)保险单(凭证)、运单(货票)、提货单、发票(货价证明);
(二)承运部门签发的货运记录、普通记录、交接验收记录、鉴定书;
(三)收货单位的入库记录、检验报告、损失清单及救护货物所支付的直接费用的单据;
(四)被保险人所能提供的其他与确认保险事故的性质、原因、损失程度等有关的证明和资料。保险人收到被保险人的赔偿请求后,应当及时就是否属于保险责任作出核定,并将核定结果通知被保险人。情形复杂的,保险人在收到被保险人的赔偿请求并提供理赔所需资料后三十日内未能核定保险责任的,保险人与被保险人根据实际情形商议合理期间,保险人在商定的期间内作出核定结果并通知被保险人。对属于保险责任的,在与被保险人达成有关赔偿金额的协议后十日内,履行赔偿义务。
第二十条
保险货物发生保险责任范围内的损失时,保险金额等于或高于保险价值时,保险人应根据实际损失计算赔偿,但最高赔偿金额以保险金额价值为限;保险金额低于保险价值的,保险人对其损失金额及支付的施救保护费用按保险金额与保险价值的比例计算赔偿。
保险人对货物损失的赔偿金额,以及因施救或保护货物所支付的直接合理的费用,应分别计算,并各以不超过保险金额为限。
第二十一条
保险货物发生保险责任范围内的损失时,如果根据法律规定或有关约定,应当由承运人或其他第三者负责赔偿部分或全部的,被保险人应首先向承运人或其他第三者提出书面索赔,直至诉讼。保险事故发生后,保险人未履行赔偿义务保险金之前,被保险人放弃对有关责任方请求赔偿的权利的,保险人不承担赔偿责任;如被保险人要求保险人先予赔偿,被保险人应签发权益转让书和应将向承运人或第三者提出索赔的诉讼书及有关材料移交给保险人,并协助保险人向责任方追偿。
由于被保险人的故意或重大过失致使保险人不能行使代位请求赔偿权利的,保险人可以相应扣减保险赔偿金。
第二十二条
经双方协商同意,保险人可将其享有的保险财产残余部分的权益作价折归被保险人,并可在保险赔偿金中直接扣除。
第二十三条
被保险人与保险人发生争议时,应当实事求是,协商解决,双方不能达成协议时,可以提交仲裁机关或法院处理。
本保险合同适用中华人民共和国法律(不包括港澳台地区法律)。
铁路货物运输保险条款(2009版)
保险标的范围
第一条
凡在国内经铁路运输的货物均可为本保险之标的。
第二条
下列货物非经投保人与保险人特别约定,并在保险单(凭证)上载明,不在保险标的范围以内:金银、珠宝、钻石、玉器、首饰、古币、古玩、古书、古画、邮票、艺术品、稀有金属等珍贵财物。
第三条
下列货物不在保险标的范围以内:蔬菜、水果、活牲畜、禽鱼类和其它动物。
第四条
本保险分为基本险和综合险,保险人按保险单注明的承保险别分别承担保险责任。
保险责任
第五条
本保险分为基本险和综合险,保险人按保险单注明的承保险别分别承担保险责任
第六条 基本险
由于下列保险事故造成保险货物的损失和费用,保险人依照本条款约定负责赔偿:
(一)火灾、爆炸、雷电、冰雹、暴风、暴雨、洪水、海啸、地陷、崖崩、突发性滑坡、泥石流;
(二)由于运输工具发生碰撞、出轨或桥梁、隧道、码头坍塌;
(三)在装货、卸货或转载时,因意外事故造成的损失。
(四)在发生上述灾害、事故时,因施救或保护货物而造成货物的损失及所支付的直接合理的费用。
第七条 综合险
本保险除包括基本险责任外,保险人还负责赔偿:
(一)因受震动、碰撞、挤压而造成货物破碎、弯曲、凹瘪、折断、开裂的损失;(二)因包装破裂致使货物散失的损失;
(三)液体货物因受震动、碰撞或挤压致使所用容器(包括封口)损坏而渗漏的损失,或用液体保藏的货物因液体渗漏而造成保藏货物腐烂变质的损失;
(四)遭受盗窃的损失;
(五)因外来原因致使提货不着的损失;
(六)符合安全运输规定而遭受雨淋所致的损失。
责任免除
第八条
由于下列原因造成保险货物的损失,保险人不负责赔偿:
(一)战争、军事行动、扣押、罢工、哄抢和暴动;
(二)地震造成的损失;
(三)核反应、核子幅射和放射性污染;
(四)保险货物的自然损耗,本质缺陷、特性所引起的污染、变质、损坏,以及货物包装不善;
(五)在保险责任开始前,保险货物已存在的品质不良或数量短差所造成的损失;
(六)市价跌落、运输延迟所引起的损失;
(七)属于发货人责任引起的损失;
(八)投保人或被保险人的故意行为或违法犯罪行为。
第九条
由于行政行为或执法行为所致的损失,保险人不负责赔偿。
第十条
其他不属于保险责任范围内的损失,保险人不负责赔偿。
责任起迄
第十一条
保险责任自签发保险单(凭证)后,保险货物运离起运地发货人的最后一个仓库或储存处所时起,至该保险单(凭证)上的目的地的收货人在当地的第一个仓库或储存处所时终止。但保险货物运抵目的地后,如果收货人未及时提货,则保险责任的终止期最多延长至以收货人接到《到货通知单》后的十五天为限(以邮戳日期为准)。
保险价值和保险金额
第十二条
保险价值为货物的实际价值,按货物的实际价值或货物的实际价值加运杂费确定。保险金额由投保人参照保险价值自行确定,并在保险合同中载明。保险金额不得超过保险价值。超过保险价值的,超过部分无效,保险人应当退还相应的保险费。
投保人、被保险人义务
第十三条
投保人应履行如实告知义务,如实回答保险人就保险标的或者被保险人的有关情况提出的询问。
投保人故意或者因重大过失未履行前款规定的如实告知义务,足以影响保险人决定是否同意承保或者提高保险费率的,保险人有权解除合同。保险合同自保险人的解约通知书到达投保人或被保险人时解除。
投保人故意不履行如实告知义务的,保险人对于保险合同解除前发生的保险事故,不承担赔偿或者给付保险金的责任,并不退还保险费。

第十四条

第十五条

保险人可以对保险标的的安全状况进行检查,向投保人、被保险人提出消除不安全因素和隐患的书面建议,被保险人应该认真付诸实施。
对于因被保险人未遵守上述约定而导致保险事故的,保险人不负赔偿责任;对于因被保险人未遵守上述约定而导致损失扩大的,保险人对扩大的损失不负赔偿责任。
第十六条

赔偿处理
第十八条
被保险人向保险人申请索赔时,应当提供下列有关单证:
(一)保险单(凭证)、运单(货票)、提货单、发票(货价证明);

承保危险
1. 本保险承保保险标的物毁损或灭失之一切危险,但下列第4、5、6及7条另有规定者除外。
2. 本保险承保因避免保险事故所致损失而产生的且依据运送契约及适用之法律与惯例理算确定之共同海损及救助费用,但下列第4、5、6及7各条款及其他除外事项不包括在内。
3. 本保险另对被保险人在运送契约内“双方过失碰撞条款”所负之责任,按照保单应付之比例额予以赔偿。倘船舶所有人依据该条款要求赔偿时,被保险人应立即通知保险人,保险人有权自费为被保险人就该赔偿提出抗辩。
除外事项
4. 本保险在任何情况下均不承保下列事项:
4.1 归因于被保险人之故意不当行为所致之毁损灭失或费用。
4.2 保险标的物之正常漏损、重量或容量之正常减少,或自然耗损。
4.3 由于保险标的物之包装或配制不固或不当所致之毁损灭失或费用。
(本条款4.3所指之「包装」包括集装箱或底盘内之堆放,但此项堆放以完成于本保险生效前或由被保险人或其受雇人所为者为限)。
4.4 由于保险标的物之固有瑕疵或性质所致之毁损灭失或费用
4.5 直接由于迟延所致之毁损灭失或费用,即使此项迟延系因承保危险所致者。(但上述第2条可支付之费用不在此限)。
4.6 因船舶所有人、经理人、租船人或营运人之无力偿债或财务失信所引起之毁损灭失或费用。
4.7 由于使用核子分裂或融合或其他类似反应或放射能,放射性物质之武器所引起的毁损灭失或费用。
5.1 本保险无论如何,不承保下列事项所引起之毁损灭失或费用:船舶或驳船之不适合安全航行。船舶、驳船、运输工具、集装箱或底盘不适合保险标的物之安全装运。但上述不适航、不适运,以被保险人或其受雇人于保险标的物装船时已知情者为限。
5.2 保险人放弃违反船舶适航及船舶适运保险标的物至目的地之任何默许的保证,但被保险人或其受雇人对于此项不适航或不适运已知情者不在此限。
6. 本保险在任何情况下均不承保下列事项所致之毁损灭失或费用
6.1 战争、内战、革命、叛乱、颠覆或因而引起之内乱,或来自交战国或其对抗之敌对行为。
6.2 捕获、扣押、拘留、禁制或扣留及其结果,或任何此项之企图。
6.3 遗弃之水雷、鱼雷、炸弹或其他武器。
7. 本保险在任何情况下均不承保下列事项所致之毁损灭失或费用
7.1 由于罢工工人、停工工人、或参与劳工骚扰、暴动或内乱之人所致者。
7.2 因罢工、停工、劳工骚扰、暴动或内乱所产生者。
7.3 由于任何恐怖份子或因政治动机之行为所致者。
保险期间
8 本保险自货物离开本保险单所载地点之仓库或储存处所开始运输时生效,经正常之运送过程,于下述之一情况时为止。
8.1 交付与本保险单所载目的地收货人所属或其他最终之仓库或储存处所。
8.2. 交付与本保险单所载目的地或其途中之任何其他仓库或储存处所而由被保险人用为:
8.2.1 正常运送过程以外之储存,或
8.2.2 货物之分配或分发,或
8.3 被保险货物自货轮于最终卸货港卸载完毕之日起届满60天,以上三种终止情形以孰先发生者为准。
8.4 如被保险货物自货轮于最终卸货港卸载完毕后,而在本保险尚未终止时,欲再运往本保险单所载以外之其他目的地时,本保险之效力仍受前述保险终止约定之限制,但应于该项货物开始再运往其他目的地时终止。
8.5 本保险对于非由被保险人所能控制之迟延、偏航、被迫卸货、重运或转船,以及船东或船舶租用人依据运送契约授权自由裁量所作的任何航程变更期间继续有效(但仍受上述终止之约定,及以下第9条之限制)。
9. 在被保险人无法控制情况下,运送契约在原定目的港以外之港口或地点终止,或因其他缘故在货物未能如前述第8条之约定交货前该运送即告终止时,则本保险亦同时终止,除非保险人立即接获通知并被要求继续保险效力,并于必要时加收保险费,则本保险仍得有效,以迄下列情形之一者为止。
9.1 货物已在该港或该地出售并交付,或者,除非另有特别约定,则以被保险货物到达该港或该地届满60天,二者以孰先发生者为准。
9.2 如货物在上述60天内(或在任何协议延长之期间内)运往本保险所定的目的地或其他目的地时,本保险之效力依上述第8条之约定终止。
10. 本保险生效后,如被保险人变更目的地,应立即通知保险人,使本保险继续有效,但须另行确定保险费及条件。
理赔
11.1 被保险人在损害发生时,须对保险标的物具有保险利益,始能要求本保险之赔偿。
11.2 依上述11.1之约定,被保险人对保险期间内所发生之保险标的物之损失,有权利要求赔偿,即使损失发生于保险契约签订之前亦同,但被保险人知道损害已经发生而保险人不知者,则不在此限。
12. 由于本保险所承保危险之发生,致使被保险航程在本保单所载明以外之港口或地点终止时,被保险人因卸货、转运费用条款储存及转运保险标的物至保单所载明目的地,其所支出之适当而合理之一切额外费用,保险人同意予以补偿。本条不适用于共同海损或救助费用,除仍须受上述4、5、6、7条除外约定之限制外,并且不包括因被保险人或其受雇人之过失、疏忽、无力清偿或债务失信所引起之费用。
13. 除非保险标的物之实际全损显已无法避免,或其恢复、整修及运还原承保目的地之费用,势将超过其抵达后之价值而经合理委付者,被保险人不得以推定全损请求赔偿。
14.1 若被保险人对本保险之货物投保增值保险时,该货物协议价值应视为本保险与增值保险的保险金额之总和,而本保险之责任则按其保险金额占上述保险总金额之比例分担之。索赔时被保险人须向保险人提出所有其他保险有关保险金额之证明。
14.2 本保险为增值保险时,必须适用下列条款:
被保险人投保同一损害危险之增值保险,该货物协议价值应视为原保险与全部增值保险二者保险金额之总和,而本保险之责任则按其保险金额占上述保险总金额之比例分担之。索赔时被保险人须向保险人提出所有其他保险有关保险金额之证明。
保险之利益
15. 承运人或其他受托人不得妄用本保险之利益。
损失之减轻
16. 被保险人及其受雇人及代理人对本保险之可赔损失,应尽下列义务:
16.1 应采取避免或减轻上述损失之适当措施。及
16.2 一切对抗承运人、受托人或其他第三者之权利应予适当保留及行使。保险人同意除本保险可得之任何损失赔偿外,对于被保险人为履行上述义务所作适当、合理支出之一切费用另予补偿。应采取避免或减轻上述损失之适当措施。
17. 被保险人为救助、保护或恢复保险标的物所采取之措施,不得视为对委付之放弃或接受,或影响任何一方当事人之权益。
迟延之避免
18. 被保险人在其所能控制之一切情况下应作合理而迅速之处理,为本保险之必要条件。
法律及惯例
19.本保险适用英国法律及惯例。
协会货物条款(B)
承保危险
1. 本保险承保下列风险但以下第4、5、6、7条文另有规定者除外:
1.1 保险标的物之毁损或灭失合理归因于:
1.1.1 火灾或爆炸。
1.1.2 船舶或航船触礁、搁浅、沉没或倾覆。
1.1.3 陆上运输工具之翻覆或出轨。
1.1.4 船舶之驳船或运输工具与除水以外之任何外界物体之碰撞或接触。
1.1.5 在避难港卸货。
1.1.6 地震、火山爆发或闪电。
1.2 由于下列原因所致保险标的物之毁损或灭失:
1.2.1 共同海损牺牲。
1.2.2 投弃或浪击落海。
1.2.3 海水、湖水或河水浸入船舶、驳船、船舱、运输工具、货柜、货箱或储存处所。
1.3 在装船或卸时、货物整件落海或掉落之全损。
2. 本保险承保因避免保险事故所致损失而产生的且依据运送契约及适用之法律与惯例理算确定之共同海损及救助费用,但下列第4、5、6及7各条款及其它除外事项不包括在内。

9.1 货物已在该港或该地出售并交付,或者,除非另有特别约定,则以被保险货物到达该港或该地届满60天,二者以孰先发生者为准。
9.2 如货物在上述60天内(或在任何协议延长之期间内)运往本保险所定其他目的地时,本保险之效力依上述第8条之约定终止。
10. 本保险生效后,如被保险人变更目的地,应立即通知保险人,使本保险继续有效,但须另行确定保险费及条件。
理赔
11.1 被保险人在损害发生时,须对保险标的物具有保险利益,始能要求本保险之赔偿。
11.2. 依上述11.1之约定,被保险人对保险期间内所发生之保险标的物之损失,有权利要求赔偿,即使损失发生于保险契约签订之前亦同,但被保险人知道损失已经发生而保险人不知者,则不在此限。
12. 由于本保险所承保危险之发生,致使被保险运输在本保单所载明以外之港口或地点终止时,被保险人因卸货、储存及转运保险标的物至保单所载明目的地,其所支出之适当而合理之一切额外费用,保险人同意予以补偿。本条不适用于共同海损或救助费用,除仍须受上述4、5、6、7条除外约定之限制外,并且不包括因被保险人或其受雇人之过失、疏忽、无力清偿或债务失信所引起之费用。
13.除非保险标的物之实际全损显已无法避免,或其恢复、整修及运还原承保目的地之费用,势将超过其抵达后之价值而经合理委付者,被保险人不得以推定全损请求赔偿。
14.1 若被保险人对本保险之货物投保增值保险时,该货物协议价值应视为本保险与增值保险的保险金额之总和,而本保险之责任则按其保险金额占上述保险总金额之比例分担之。索赔时被保险人须向保险人提出所有其他保险有关保险金额之证明。
14.2 本保险为增值保险时,必须适用下列条款:被保险人投保同一损害危险之增值保险,该货物协议价值应视为原保险与全部增值保险二者保险金额之总和,而本保险之责任则按其保险金额占上述保险金额之比例分担之。索赔时被保险人须向保险人提出所有其他保险有关保险金额之证明。
保险之利益
15. 承运人或其他受托人不得妄用本保险之利益。
损害之减轻
16. 被保险人及其受雇人及代理人对本保险之可赔损失,应尽下列义务。
16.1 应采取避免或减轻上述损失之适当措施。及
16.2 对于承运人、受托人或其他第三者之一切对抗权利应予适当保留及行使。保险人同意除本保险可得之任何损害赔偿外,对于被保险人为履行上述义务所作适当、合理支出之一切费用另予补偿。
17. 被保险人或保险人为救助、保护或恢复保险标的物所采取之措施,不得视为对委付之放弃或接受,或影响任何一方当事人之权益。
迟延之避免
18. 被保险人在其所能控制之一切情况下应作合理而迅速之处理,为本保险之必要条件。
法律及惯例
19. 本保险适用英国法律及惯例。
协会货物条款(C)
承保危险
1. 本保险承保下列危险,但以下第4、5、6、7条另有规定者除外:
1.1 保险标的物之毁损或灭失合理归因于:
1.1.1 火灾或爆炸。
1.1.2 船舶或驳船搁浅、触礁、沉没或倾覆。
1.1.3 陆上运输工具之倾覆或出轨。
1.1.4 船舶、驳船或运输工具与除水以外之任何外界物体之碰撞或接触。
1.1.5 在遇难港卸货。
1.2 由于下列原因所致保险标的物之毁损或灭失:
1.2.1 共同海损牺牲。
1.2.2 投弃。
2. 本保险承保因避免保险事故所致损失而产生的且依据运送契约及适用之法律与惯例理算确定之共同海损及救助费用,但下列第4、5、6及7各条款及其他除外事项不包括在内。
3. 本保险另对被保险人在运送契约内「双方过失碰撞条款」所负之责任,按照保单应付之比例额予以赔偿,倘船舶所有人依据该条款要求赔偿时,被保险人应即通知保险人,后者得自费为被保险人就该赔偿要求提出抗辩。
除外事项
4. 本保险在任何情况下均不承保下列事项:
4.1 归因于被保险人之故意不当行为所致之毁损灭失或费用。
4.2 保险标的物之正常漏损、重量或容量之正常减少,或自然耗损。
4.3 于保险标的物之包装或配制不固或不当所致之毁损灭失或费用(本条款4.3指之「包装」包括集装箱或底盘内之堆放,但此项堆放以完成于本保险生效前或由被保险人或其受雇人所为者为限)。
4.4 由于保险标的物之固有瑕疵或性质所致之毁损灭失或费用。
4.5 直接由于迟延所致之毁损灭失或费用,即使此项迟延承保危险所致者。
4.6 船舶所有人、经理人、承租人或营运人之无力偿债或财务失信所引起之毁损灭失或费用。
4.7 由于任何人之恶意行为对保险标的物全部或部分的故意毁损或破坏。
4.8 由于使用核子分裂或融合或其他类似反应或放射能、放射性物质之武器所引起毁损灭失或费用。
5.1 本保险在任何情况下,不承保下列事项所引起之毁损灭失或费用:
船舶或驳船之不适合安全航行。
船舶、驳船、运输工具、集装箱或底盘不适合保险标的物之安全装运。
但上述不适航、不适运,以被保险人或其受雇人于保险标的物装船时已知情者为限。
5.2 保险人放弃违反船舶适航及船舶适运保险标的物至目的地之任何默示保证,但被保险人或其受雇人对于此项不适航或不适运已知情者不在此限。
6. 本保险在任何情况下均不承保下列事项所致之毁损灭失或费用:
6.1 战争、内战、革命、叛乱、颠覆或因而引起之内乱,或来自交战国或其对抗之敌对行为。
6.2 捕获、扣押、拘留、禁制或扣留及其结果,或任何此项之企图。
6.3 遗弃之水雷、鱼雷、炸弹或其他武器。
7. 本保险无论无论如何,不承保下列事项所致之毁损灭失或费用
7.1 由于罢工工人、停工工人、或参与劳工骚乱、暴动或内乱之人所致者。
7.2 因罢工、停工、劳工骚乱、暴动或内乱所产生者。
7.3 由于任何恐怖份子或任何人因政治目的之行为所致者。
保险期间
8. 本保险自货物离开本保险单所载地点之仓库或储存处所开始运输时生效,经正常之运送过程,于下述情况之一时为止。
8.1 在本保险单所载目的地交付收货人运送至或其他最终仓库或储存处所。
8.2 由被保险人选择在交付本保险单所载目的地或其途中之任何其他仓库或储存处所而由被保险人用为:
8.2.1 正常运送过程以外之储存,或
8.2.2 货物之分配或分发,或
8.2.3 被保险货物自货轮于最终卸货港卸载完毕之日起届满60天,
以上三种终止情形以孰先发生者为准。
8.3 如被保险货物自货轮于最终卸货港卸载完毕后,而在本保险尚未终止时,欲再运往本保险单所载以外之其他目的地时,本保险之效力仍受前述保险终止约定之限制,但应于该项货物开始再运往其他目的地时终止。
8.4 本保险对于非由被保险人所能控制之迟延、偏航、被迫卸货、重运或转船,以及船东或船舶租用人依据运送契约授权自由裁量所作之航程变更期间继续有效(但仍受上述终止之约定,及以下第9条之限制)。
9. 在被保险人无法控制情况下,运送契约在原定目的港以外之港口或地点终止,或因其他缘故在货物未能如前述第8条之约定交货前被运送即告终止时,则本保险亦同时终止,倘若保险人立即接获通知并被要求继续保险效力,并于必要是加收保险费,则本保险仍得有效,以迄下列情形之一者为止。
